    .45 1911

A friend asked me the following question...

My uncle in Arizona wants to give me a gun.
How do we do this legally? Can he PPT? FTF?
Just hand it to him? DROS through an FFL?
He probably wants as little government involved as possible.

    Thank you for your help.

Uncle in Az can't give you Ca resident a gun. Az uncle can't Ca PPT you Ca resident a gun. PPT is only between two Ca residents at one Ca FFL. FTF not actable. That's my best, I could be wrong but I feel pretty informed on this topic.

Someone might suggest your uncle could give the gun to his parent your grandpa/grandma and your grandpa/grandma could give the gun to you. I'm not suggesting you should break the law, you should comply with all laws. I'm not a lawyer and this isn't legal advise but I think it's illegal to complete two legal transactions to bypass an illegal transaction. Even then when done legally, it's between an out of state parent/grandparent and child/grandchild in Ca, it's an out of state transaction, it's considered an interstate transfer and the transfer must be in compliance with such, a DROS is completed at a Ca FFL, the 1 in 30 days handgun law still applies, safe roster does not apply though and an out of state intra-family transfer must be completed in nearly every case through a Ca FFL. I'd bet there's a lot of government paper work on both sides to be completed in that case. Even though an intra-family interstate transfer doesn't apply to uncle and nephew, see the link below for details on transfers. This topic has been covered in depth on Calguns, so also try the search bar and the calguns google search for more info. What's the gun? Is it on the approved handgun roster? Not that it matters just wondering out of curiosity.

OP, you would get more useful replies if the title of your thread was more on subject.

If it's on the roster it could be sent to a California FFL and then transferred to the OP. Extra fees will usually apply as it's not a PPT and the FFL logs it into his inventory before transferring to the OP. Same thing as what happens when you purchase a on-roster handgun off of Gunbroker or at Bud's Gun Shop, etc. Also if the 1911 is C&R (over 50 years old) it could be transferred the same way as it is roster-exempt.

If it is off-roster and not C&R it could be SSE'd through a California FFL that does single-shot exemptions.

Hard to say without knowing exactly what type of 1911 it was.

Transfer would have to go through an FFL. FFL will only do it if it is either an on roster gun, made SSE, or if the person receiving the gun is roster exempt (LEO).

Alternatively the person receiving the gun could move to Arizona, get handed the pistol no FFL involved, then at a later date move back to Commiefornia. After moving back a new resident registration of the 1911 would need to be done.
