TAX ON DROS?!?

    TAX ON DROS?!?

    I recently have two firearms through Turner's Outdoorsman and I noticed during check out they charged me tax on the DROS...

    Is that legal?!

    I saw this here saying its not allowed to tax DROS..

    CA DROS is $25. The FFL can charge up to $5 ($30 total) for their own fee, or $10 ($35) for PPT's.

    AFAIK tax isn't applicable on DROS fees.

    Edit: what was the transaction type? New purchase? FFL transfer? PPT? Need more info... CA sales tax is applicable on the price paid for the firearm, if it is an FFL transfer and coming from outside the state.

        I just did a PPT. 35 bucks, no tax.

        I am looking at the receipt.

        I don't the state collects taxes on fees in general right? Can you tax a tax? That **** would never end.

          Don't think I've ever seen a limit on what a dealer can charge (except $10 on a PPT). This extra dealer's fee, however, cannot be misrepresented as a state fee and it would be taxable. DROS is $25 and is not taxable.

            I've bought many firearms from Turner's and they always represent their $5 fee as a Turner's fee, not as a state fee. And they only charge tax on that $5 fee, not on the $25 in state DROS fees.

              The girl charged me tax I am sure of it I will post the receipt it was for two long guns purchased from the store. The amount was 30 dollars and the tax was roughly 40 cents. I mentioned to the girl you can't usually charge tax on services and she said have to per turners in Norwalk.

                  Forty-five cents would be 9% tax on $5...their fee, not DROS

                    DROS is $25. PPT is $35. Neither is taxable. Transfer fees and dealer fees are set by the dealer and have limit, and are usually taxable. As I interpret the tax code, if the firearm is taxable, my fees are taxable.

                      the 40 cents is the tax on their additional $5 fee, not on the $25 portion of it.

                        Tax in CA is about 9 cents on the dollar. 9 times 5 = 45 cents. So she taxed you on the 5 dollar dealer fee.

                          I learned something here!!

                          I guess Im just used to gunstores just charging the fee ($25) without any taxes. Turners is the only store I been that did this. Made me a bit confused...

                            Turner's is the only store I've ever been to that charges an additional fee just for their own enrichment. Every other gun I've purchased has only had the $25 DROS (or $35 for PPT).

                            Why does Turner's charge this extra $5? It seems like a crappy policy, but people keep paying it so they keep charging it. It's the "you have the privilege of purchasing a firearm from us" fee.

                              There is a shop in Manteca that charges tax on DROS fee. Of course they also want two forms of ID for long gun purchase...
