    Help! FFL Has Reneged

    Hello Fellow Calguns.net Members:

Since California will require registration of long guns after January 1, I decided to buy a long gun before the law goes into effect. I discussed purchasing a Saiga IZ132, a sporter model, with my FFL earlier today, and he agreed to go ahead with it. Originally, we were looking at Bud's Gun Shop and Gunbroker.com. Both mentioned it was California compliant as did other vendors. However, I found an even better deal here on Calguns.net for one via the thread at http://www.calguns.net/calgunforum/showthread.php?t=802003, and I went ahead and ordered from the store recommended in that thread around 3 or 4PM today, Classic City Firearms, a transaction totaling $470, including shipping.

Not sure here whether to mention names, but after forwarding the receipt Classic City Firearms E-mailed me to my FFL who's handled all my transactions requiring an FFL, he responded via E-mail around 6PM that I should contact the CA DOJ about this firearm and its legality in California, and after discussing the matter over the phone with him a short time later, he reneged on handling the transaction. Now I'm in a bind about how to handle the situation so that help here would be appreciated.

    Thanks!

Find another FFL. That gun is well known in CA and the FFL that told you to contact the DOJ is an idiot. There is a sticky in the rifle section on FFL's that do PPT.

Its just a typical sporterized saiga 7.62 right? Nothing special there. Sounds like your FFL doesnt know what hes talking about...There is no reason why that gun cannot be owned/sold in CA.

      blazeaglory:

This FFL's price is a lot lower than the shop he recommended here, like $40 versus $110, and that was part of my reason for my going ahead with the transaction. I've also sent him a link to the thread here at Calguns in my first post which had the link to the Saiga IZ132 for $470 OTD.

Others in the thread claim Turners here in Caliofrnia typically sells the same gun but at a higher price, but they were out of stock of it anyway. It also actually sold for even less before this scare began, but it's a good firearm, built by a very reputable company, one of the oldest gun manufacturers in the world, Izhmash Arms Factory in Russia.

      Thanks!

Yes its a good gun. Sometimes Turners has them in stock but they sell quick. Im from Southern CA so Im no help to you down here...

Hopefully your usual FFL will come around. Tell him they sell that rifle everywhere in CA. Like you did, find other threads on calguns that show that gun is good to go.

Maybe he doesnt want you to own it

Well, it would break a valid contract at least. If memory of the law serves, the Statute of Frauds only requires written agreements for amounts over $500, and besides the fact that we're talking $40 plus tax for the FFL to handle the transaction, this firearm sold for $470. Moreover, we have E-mails, and I even forwarded the receipt after the transaction took place.

OP you have to ask yourself is the trouble worth $70 or not. You might spend days going back and worth with this cheaper FFL and go nowhere with it. I don't believe this FFL is obligated to accept the shipment for you. If he wants you to get something from the CA-DOJ then you are in one helluva ride.

You might be able to hold him accountable for it but then is it really worth your time? I'm not saying who is right or who is wrong, just looking at the end results here. What happens when you spend all the time and energy but got you no where. You could be happily shooting by paying $70 more.

He saw the same sites I saw, even recommended my bidding for one on Gunbroker.com, which I did but lost. I could take him to court over breaking the contract. However, I've got too much legal stuff on my plate, a federal suit regarding law school even. LOL!

If you are going to pull a Law Book on your FFL Dealer he doesn't want your business.

Yes, there was once a time I also thought a preemptive strike to the gearbox reproductive parts area was a good idea when I knew I'd need future cooperation.

I wasn't born yesterday, hambam! That's more B.S., like telling you security you hired doesn't want your business after you had made arrangements beforehand with them for a big event, and they don't show up as arranged.

Are you going to stand by while they furher take away our rights? Turners here in CA sells this very same firearm, and, again, my FFL even suggested bidding on one on Gunbroker, even showing me the auction listing there.

Now, after I make a purchase from a post/thread here on Calguns.net, he has balked at it. Besides it taking time and potentially more money, it has already caused some emotional distress as well, and if I can't him to see the light or get another FFL to handle the transaction, can't get security elsewhere to come on such short notice if need be as it were, it would give me even more reason to take the FFL, or security company in my analogy, to court after the fact; it has nothing to do with wanthing business or a "Law Book."

What about calling Kamila and the DOJ, wouldn't someone who conspired to violate California law and not even protect, let alone enforce Proposition 8 and State law on handling voter referendums, feel she can do any extra-legal thing she wants in our Great State and Republic?!? Wouldn't calling her office be something akin to calling your soon-to-be-ex wife's divorce attorney's office to find out the best way you can settle the matter?!?

Anyway, now I'm also worried I won't have as much fun at the range.

Fairfield Pawn is only $20 for transfers. Must be in ca legal config when shipped though.

Good. I have done a ton of transfers there. Very efficient each and every time.

Cool comment on your hobby, cannon, but I suppose I'm talking about the aggravation. It's kind of cleared up, but I'm not happy about it on most levels. I would have liked to remain friends with my apparently former FFL. On the other hand, the FFL I'm using's in the same city as the gun club where I belong, and he's in Solano rather than Napa county too.

P.S. You need to delete one of those duplicate posts if you can.
