    PPT questions

    I am ton thinking about downsizing the collection and selling off a few guns via PPT. I have never sold any pf my guns, and if I list them in classifieds then the buyer is going to somebody I don't know.

    #1) If the buyer pays me for the gun, then fail the DROS and the gun is stuck in jail at the LGS, what happens?

    Does the buyer get stuck "owning" a gun that cannot possess, and it's up to them to find a new buyer that can take delivery?

    Once the seller (me) hands the gun to the LGS to do the paperwork, and the buyer pays me, is my obligation over with?

    From what I know, if they fail the DROS then you get the gun back. Is make them pay for the transfer incase they do fail. That way you don loose out if they do fail because they will not refund you the fee.

      Do I have to have the gun shop DROS it back to me in that situation?

        I'm pretty sure that isn't required from what I've read before. I'm sure this has been posted on here before. I'd email the FFL you are going to use or any FFL to figure out the law.

        I've done a few PPT's with fellow calgunners. It's a breeze.

          if the buyer fails the DROS, CADOJ will automatically do a background check on the seller. if the seller is OK, then the FFL is told to return the firearm back to the seller. there is no new DROS required and no 10-day wait. It is just handed back to the seller. (the seller might have to fill out a 4473, not sure about that, but no DROS).

          if the seller is prohibited, then it gets complicated and the FFL is supposed to turn the firearm to the local LEA.

              Don't forget to put some kind of terms of sale on paper and have the buyer initial all points and sign it.

              Make sure to include a 15-30% "restocking" fee if the buyer fails DROS.
              Make sure the buyer is responsible for the $35 PPT and that its non refundable from you or the dealer performing the PPT.
