Just read the Riflegear thread.Didn't want to threadjack.

I know a parent can give a gun as a gift to a child.As far as I know age of parent and child don't matter.

Is an adult parent buying a firearm as a gift to an adult child a straw purchase?

Assuming adult child is not a "prohibited person".

You buy your kid a rifle and pay for it. Pick it up and say "happy birthday" and you're fine.

Your kid gives you $2,000 and tells you which rifle to buy. You go in, fill out the paperwork, and use your kid's cash to buy the rifle so that they don't have to do the paperwork...that is a different story.

Buying a rifle for you kid, paying for it yourself and giving it to them is one thing.

But two adults go into a shop and one is doing all the talking and the "buyer" looks clueless is sadly in this day and age going to raise red flags. Especially when the "buyer" is asking for something specialized like an ACR or a "combat" shotgun with a bayonet.

Unfortunately the straw purchase card gets pulled a lot when the buyer is a women and the 2nd party is a male. Is it sexist to assume that a women does not want a firearm, sure it could be if that is their prejudice. And generally that is the card that gets pulled in response to the straw purchase card. But I would wager most straw purchases are GF/Wives buying for the man. Or in these recent cases Moms for Sons apparently...

I think many shops take the stance that when they find out its going to be a gift if the recipient is there in the shop, of legal age, and (supposedly) legal to own the firearm; then why not do the paperwork in their name?
If the gift recipient can legally own firearms then there should be no hitch.
Its quick CYA for the shop.
Many won't even do that and just shut down the sale.

But it looks weird and there is someone of legal age standing there telling them about it.

The straw buy thing is hard for the shops to deal with. Hard for them to really know unless someone is being stupid obvious. There are penalties beyond a slap on the wrist for entertaining a straw buy for a dealer. My cousin bought a Mosin. Got all kinds of crap from more than one place when shopping for it according to other family members. Unfortunately the result was a rifle I may have to spend quite a bit of time with eventually if it is to ever be right.

The problem was my cousin is female. She was 19 or 20 at the time and she is Asian. A 91 is a lot of rifle even as she is 5'10" and the gun store employees thought she was straw buying for a BF she didn't even have at the time. To make matters worse, she had a coworker with her at one place. So she end up with a lemon from a place that either did not care or thought they were pulling a fast one and dumping a pile on her. If this was still a free country none of this crap would matter.

As for that Riflegear thing, the buyer came right out and said she was buying it for her son, then said it was for her when they suggested he come buy it himself. When they can't keep their story straight it makes it kinda obvious.

No. Esp if you keep it hypothetical. 'This one day may be yours' et cetera...

At least thats what I did when I was at riflegear... with my daughter.... buying stuff.
