Family transfer from my dad

I tried looking through the stickies, but I was overwhelmed with info.

So I'm just going to ask for the simple answer... My dad is a resident of another state and wants to gift me an off roster pistol when he visits next month. It's a 1911 so no issues with magazines.

How can we transfer the pistol?

You need to do the transfer through a California dealer. It can't be done as a PPT if your dad doesn't have a California or military ID, so it won't be eligible for the $35 PPT maximum fee. The dealer can charge whatever he wants for the transfer. Some charge over $100, so shop around. Also, a large number of California dealers don't understand how to process roster exempt family transfers from out of state family members. So you will need to do some searching to find one who will transfer it for you. Your dad should bring a letter that says he is giving the gun to you as a gift and includes a description of the handgun. The dealer will want to keep this for his records.

You'll need all the same documentation you would need if you were buying a handgun from the dealer...California DL or ID, proof of residency, HSC or exemption, etc.

Many dealers will tell you to just send in the self registration form instead of doing the transfer though an FFL. This would comply with California law, but would be a violation of federal law.

Try calling Kerley's in Cupertino. I just did a slightly unusual transfer there (inherited handguns but the estate attorney insisted they go through an FFL) and they didn't seem to have a problem with it.
