    Question about selling an inherited shotgun

    This one might be for Librarian. I have done thread searches and read the wikis but I am still a little unclear.

    When my grandfather, Texas resident, passed away I received his shotgun. I am not sure if I technically inherited it because there was no paper will, only his spoken word that he wanted me to have it. I now wish to sell it, and I just want to make sure there will no surprises for me or the buyer when we ppt.

    Any help, info, suggestions?

      First suggestion: we've got to start telling our aging relatives to have some kind of legally-sufficient written document to direct disposition of our guns.

      If we have such a document, naming people to receive the guns, then we get to skip the FFL requirement on interstate (e.g. TX to CA) inheritance. Without the document, or a court-supervised probate, interstate transfers are supposed to go through an FFL in the receiver's state of residence. It does not seem to happen often, but messing that up and being convicted could lead to a $10,000 fine and/or five years in Federal prison - per gun.

      Get a piece of 8.5 x 14 paper, roll it into a cone and tape it or staple it, put it on your head and go stand in a corner.

      Until Jan 2014, CA FFLs do not and will not collect information on the transfer of any long guns and send that info to Sacramento (it is on a Federal 4473). CA-DOJ has no reason to expect to have any info about a long gun transferred in-state.
