    INTRAFAMILY TRANSFER

    I want to make sure I have this right. My 29 year old daughter lives in California and is legal to own long guns. I live in California. I can give her my long guns any time I want without any paper work and they become hers?

    I have the gun safe here at my house. Can I keep the guns here in the safe and if for any reason LE decided to take them from me I could call her up to come get em?

    I want to make sure I protect the guns I have collected for my son. He's too young to own any guns now.
    It takes a lot of balls to play golf the way I do.

    If a cop came to get them, he'd take them all, because they aren't registered to any specific person, and since they're in your home, they're your implied possession.

    In regards to giving your rifles to your daughter, you're free to do so, no paperwork needed. That's assuming they're regular long rifles, such as an old M1 Carbine, double barrel shotgun, etc. You get the idea.

    You WILL have to start registering NEW long rifle purchases beginning in 2014.

      Thank you....yes, they are new lever guns and a couple shotguns.
      It takes a lot of balls to play golf the way I do.

        There is currently no age restriction for your son to own long guns. If you are both California residents you can give your son a long gun on the day he is born. You can give him a handgun when he is 18 years old. Starting next year California law will reqire your son to be at least 18 years old before you can give him any firearm.

          Await a second, I started buying long guns this year to eventually pass on to my son. He is 7years old. I worry about not being to transfer them to him in the future. Can idol this now? I also own two hand guns what should I do with those? I plan to leave ALL my guns to my son and never sell any of them.

            Also, I am divorced and his mom has primary custody (of course). She is a hateful selfish vindictive ruthless heartless "person". I know she would not like our son owning a gun. How can I protect my will that he own them of i'm dead?

                Good Dad...Thanks for being one.

                My advice (worth what it costs you)..is too buy a few Lowers before 1-1-14.

                These are not registered now (because they are considered long guns).

                No hurry building them up into proper AR rifles; those parts can be had anytime without a problem.

                But get those Lowers for the future. Your son will be lucky because I really think the future of Gun Control and AR rifles will not be in our favor.

                These restrictive Gun Laws seem small now. But it's a step by step process to take guns away from common citizens. As we can see, one crazy person can affect the entire Nation and our 2nd Amendment rights.

                Just my opinion Dad.

                    As his mother, she will have control of him until he is emancipated (18).
                    She will control his assets in his best interest (as seen by her). You need a lawyer to write a will which specifically ensures that the weapons pass to him and are not to be sold, or, a Gun Trust with you and him named.

                      Until the end of the year, you can give long guns to your 18+ children/grandchildren/parents/grandparents at will.

                      That also means in theory you might have given your guns to your daughter now, even if she doesn't actually take them out of the house for 20 years.

                      I would like to hear from someone with a little more knowledge if it is lawful to give firearms to minors now. I thought they had to be 18. So now, with handguns you have to be 18 and then you must complete a intrafamilial transfer form and register the handgun with the state. If they run the serial numbers they will know it isn't in your name and they will know whether the gun existed before you were 18.

                      Is that unlawful and/or is that going to apply to long guns?

                        It looks like Penal code has this covered. Transfer of non-antique handguns to minors = No (Age 21 is the cut point); Transfer of other than handguns to minors = Yes.

                        Penal Code 27505.
                        (a) No person, corporation, or firm shall sell, loan, or
                        transfer a firearm to a minor, nor sell a handgun to an individual
                        under 21 years of age.
                        (b) Subdivision (a) shall not apply to or affect the following
                        circumstances:

                        (1) The sale of a handgun, if the handgun is an antique firearm
                        and the sale is to a person at least 18 years of age.
                        (2) The transfer or loan of a firearm, other than a handgun, to a
                        minor by the minor's parent
                        or legal guardian.
                        (3) The transfer or loan of a firearm, other than a handgun, to a
                        minor by a grandparent who is not the legal guardian of the minor, if
                        the transfer is done with the express permission of the minor's
                        parent or legal guardian.

                          Thank you for the advice. I do plan to follow it. I have never thought about owning an AW (I guess the lever gun is the original AW) but I do agree with you that now might be the time and it might be a good idea to throw one or two in the safe.

                          I'm not sure what to look for when it comes to lowers. I was at a LGS today putting a new model 92 in 44 mag on a 10 day hold, They had a couple in there for way too much money. The cheapest one was 400.00 and made in Grant Pass Oregon. I think it was Battle Creek of something like that..I will do some research on em. I see Ammo Brothers has some on sale for 200.00.
