    Did this guy commit a felony?



    Was browsing GB for an AR pistol BBL and seen the above auction and though whoa no good


    Location Chula Vista CA

    Assuming he made an SBR

    if this went to court...he is committing a crime.

    Also two flash kills will be included for you SBR guys that dont want any questions. One is the standard bird cage and the the other is a 5" that simulates 16"OAL; for flying under that radar. If you wanted you could pin this one for those of you who want the XM look and be legal on a non SBR weapons. Remember you can always un pin it and have it have back to 11", or just screw it on and off at will.
    the pictures of the assembled firearm are evidence of the crime...and yes they have a right to kick in the door and look at his floor to see where the picture was taken...

        Huh? How did you know he committed a crime? He can own a <16" upper if he has a legal pistol lower. Are you saying he doesn't have such a legal pistol lower? How would you know?

          Who cares wether he has a pistol lower when he has it attached to a rifle lower. He needs a sbr permit and tax stamp. Which is unlikely in CA But like he said he's flying under the radar.

            because the picture is evidence of the crime... just because you own a pistol lower doesnt give you the right to assemble an SBR

            As I said... if this went to court, he'd be found guilty.

            the only way its not going to court is if that lower in the picture has a Stamp to cover it.

            One Stamp doesnt cover all your firearms, nor does a LEO have the right to willy-nilly assemble SBRs...but yes they do get away with doing it.

                      Not really sure how these rifles get put together so excuse my ignorance if I am way off base. If he put it together without the bolt carrier group and charging handle (if even possible) would it still be an SBR? He states no bcg or charging handle with the purchase.

                          I was replying to your first post about maybe having a pistol lower which has absolutely nothing to do with the pictures posted. Also I did not jump to any conclusions however unlikely it is that this person has the apropriate stamp for that rifle. Reading comprehension must be eluding you today.

                            Remember all NFA ATF rules apply for use on OWC, Pistol or registered SBR. Know what you are purchasing prior to bidding. Complete rifle is not included it is only for reference.

                            I'm pretty sure he knows what he has, and the lower is registered. He is only selling the upper, not the entire rifle.
