    Travelling through CA

    Hey all. I'm not sure in what section to post this question. I currently live in AZ and will be relocating to Oregon. My travels will, unfortunately, take me through California. Are there any issues with me traveling through California with my rifles (semi-automatic), magazines (10+ capacity), ammo (1k+ bulk), etc.? Everything is packed and in the back of the moving truck. Does anyone think I will have problems at the border patrol checkpoints?

    Only if they see your gear. Try this. It's seems to be the best thing to do.

      Technically, prior to entering CA, you need to disassemble all your 11+ round magazines and modify your firearms to be CA legal.

      The Firearm Owners Protection Act of 1986 gives some sort of protection for transporting through a state, but it requires you to travel straight through (no stops/extended stays) and only protects you at trial, after you are arrested, jailed & property confiscated.

      So, if you are not willing to risk being arrested, jailed and having everything confiscated; then drive through NV instead of CA.

          The U.S. Border Patrol doesn't enforce state law provisions. California does have agricultural inspection checkpoints at its borders. They don't check for firearms violations. It is a felony to import large capacity magazines. I haven't seen any cases where disassembled parts of a magazine have resulted in prosecution.

          Make sure that your rifles are in a legal configuration. The Calguns Flowcharts can help you there.

          Don't place too much faith in the FOPA. There were two cases out of New York where folks were arrested under conditions the FOPA was intended to protect against. The criminal prosecutions were not successful, but when they tried to file civil lawsuits for damages, their cases were kicked. The 2nd Circuit held the FOPA did not provide private cause of action. The U.S. Supreme Court declined to take the case.

            Thanks for all the info. no problem on taking apart the mags. To make the rifles CA legal, is all I need is the installation of a bullet button?

            I guess the reason I was asking about the Border Patrol would be the amount of ammunition I would be transporting and the possiblity of heading to secondary. Would ammunition 'cause a dog to hit. I was curious if there were any amount you could or could not transport through CA.

            I thought about traveling up through NV. I suppose I could see how much gas it would take to bypass the more direct route and the cost of the measures necessary to avoid issues in CA.

              You have to use the flow chart to find the status of your rifles, putting a bullet button on a prohibited gun doesn't work. Check the chart for your handguns and shotguns also, some are on the AWB list.

              Now, about the mags...repair parts for magazines are OK to import but the idea is that you already have the large mags that need repair already in California. Not much risk but I would not want to be the test case, just saying. Just ship those to yourself.

                You know, even going via Nevada would be longer, I'd wager your gasoline bill would MORE than make up for it.

                  The only "Border Patrol" would be at the California-Mexico border. The only thing you would encounter at the AZ-CA border is an Agricultural Inspection station. Every time I've encountered one they either just wave you though or ask if you have any fruits or vegetables in the car. If you are traveling with animals they may ask for a health certificate. I've never seen sniffer dogs and there is no restriction with the amount of ammunition you can bring into the state - just keep in mind that tracer ammo is illegal. If you have "assault rifles" you would need to install a magazine locking device prior to crossing into california.

                  Where are you moving to in Oregon? It's may be easier to drive through Nevada - even if it's further, keep in mind that gasoline is less expensive in NV

                    i dont remember a checkpoint coming from AZ along hwy 40 or the hwy10.
                    their is a agrilculture checkpoint from nev to calif. never seen them use a dog. usually calif plates drive right thru. out of state plates get stopped. only looking for fruits and vegetables. if your in a moving truck they will open the back up and look for plants. you can just take apart the mags. no need to buy a bullet button. just take the upper off and pack it seperate. put the ammo on the other side of the truck.
                    just have all your paperwork handy to show if asked. truck rental. old address, new address, new job. things like that and dont act nervous.
                    Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.
                    I really miss the good old Pomona Gun Shows.

                        Pack away the gun stuff, preferably in the front of the van or any other place not seen easy and just do not say anything. The border check point people are only looking for produce and plants.

                            LEO would need probable cause to search the vehicle, but it would probably be cheaper fuel and lodging wise to avoid CA
