C96 Legal question

    C96 Legal question

    I have a C 96 Mauser with matched stock. My understanding is, it is legal with its stock, because it is considered an antique. "1896". Looking at the Cal Guns flow chart makes me question this understanding. Anyone care to give me final word on this issue.
    And one other thing, I have invested in collectable fire arms most of my life, and would really feel put out if our 2nd amendment right is taken from us.
    They say we have the gov we voted for. I didn't vote for this.

      I believe the problem you are going to face in CA is that when the stock is attached it doesn't meet the overall minimum length.

      That said, I used to own one with an original stock. It is a blast to shoot with the stock attached but watch out for the bolt when it is at full recoil. Your face is awfully close to it!

          Here is the Skinny... if you have a C96 WITH AN ORIGINAL stock,not repro(does not have to match the pistol ser#wise) you are LEGAL OUTSIDE of Kommiefornia..... IF you put the stock on, this POS place considers it a SBR and you can get arrested for an AW at the least... the state MADE NO EXCEPTIONS for CR firearms... ALSO your C96 is a CR UNLESS the Ser# indicates it is made BEFORE 1/1/1899... your serial # on the frame would have to be like 24xxx OR UNDER.....

          I have a C96 MADE in 1897 so technically I am safe.. but the Douche LEOS.. dont trust them, so as bad as i want to try it... nope, just keep the stock for a holster..

          So there you have it... Also, congrats ,they are cool machines and when you consider the year invented and look at the machining skills.... you know that the top 1/2 including the barrel is machined from 1 piece of steel... same as the lower frame.. 1 piece hogged and milled..... no casting,no cnc,etc

          Final safety note -VERY UBER IMPORTANT, INSPECT the BOLT STOP-is on the RHS of the upper.. IF it looks BENT or TWISTED DONT shoot it!!!! if you take it apart and inspect it-you reallu must- and if you see ANY crack,fatigue,etc,DONT SHOOT IT until you get another one-available on GB and other places.... IF this part FAILS, the bolt flies back out and hits you in the eye or forehead,probably kill you.. this is the 1 fatal flaw... also, DO NOT EVER shoot 762 TOK ammo.. it IS really the same as 30 mauser bUT much hotter load..... if yours is in 9mm, standard loads are fine, no +p.

              Actually...

              The Mauser C96 with shoulder stock/holster was removed from the NFA registry as a SBR by the BATFE due to being a C&R. Because of this it is not considered a SBR under Federal laws and CA state laws [PC 17705(a)].

              However, there is no C&R exemption to CA's assault weapons laws.

              So...
              A Mauser C96 with a fixed 10 round magazine is legal in CA.
              It is also CA legal to own/possess an unattached shoulder stock/holster with that Mauser C96. [PC 17705(a)]
              But, it is illegal to attach the shoulder stock/holster to that Mauser C96. [PC 30515(a)(3)]

              In addition...
              A Mauser C96 that uses detachable magazines are illegal in CA. [PC 30515(a)(4)(D)]

              However, there is an antique exemption to CA's assault weapons laws. [PC 30515(c)(1)]

              In order to be an antique, the Mauser C96 needs to have been made before 01-01-1899. [PC 16170(a)]

              If the Mauser C96 is an antique, then it is CA legal to attach the shoulder stock/holster to it.

                Precisely what i was saying,but you were more eloquent where I am at work and had to blitz out a post..... there was a recent case where the cops busted some guy on some BS far as I remember, they saw the C96, the COPS ATTACHED IT and tried tagging him with the illegal AW..... stupid... people just dont understand the more pragmatic ways people solved issues in the past... traveling,limited on room, have a C96 with the holster/stock and have the best compromise possible.....
