    Truck Gun?

Tried searching, damn thing is broke again. I want to assume that having a shotgun inside the cab of a pickup truck (hanging in a rack) is illegal in California? Being fun and all I figure they cut that one awhile ago, anyone know for sure?

As long as it's unloaded it's okay, not the brightest idea but not illegal. Best bet is to have the shells in a separate container not accessible to the driver.

Would be out in the boonies, not the city. I have a locked device for the shells.

Why would you need a shottie in your truck?

Probably the same reason he would want one at home.

The gun would need to be unloaded under California's loaded firearm statute if you plan driving with the gun there.

Under the federal gun free school zone law, if you are in a school zone, that rack needs to be locked.

The California gun free school zone law is maddeningly ambiguous with respect to long guns, but transporting it in a vehicle unloaded is probably enough (as opposed to walking around with it on foot in a school zone).
The above does not constitute legal advice. I am not your lawyer.

You don't. But, I think the OP was asking about a shotgun not an airsoft toy "shottie."

My biggest problem with keeping a firearm in my trunk is: My trunk monkey keeps playing with it. He's allowed to use it when he has to but, he's like a little kid and won't keep his snotty little fingers off it. I do keep one under the seat in my pickup. I don't use gun racks anymore because, now a days, it's just asking to be pulled over and searched and, it's also an open invitation to tweekers to break in a steal it.

Why would you ask this question? He wants to. It's a valid question. Let's try and help the guy.

Not true. As a matter of fact, a shotgun is exactly what People v Clark was about.

And listen to monkeyman re the damn school zone issue.

You can have an unloaded rifle sitting on the passenger seat with a fully loaded magazine next to it if you want to.

(asuming of course you are not a gang member)

I use an Israli mag holder that deadeye hooked me up with to keep my A2 in 'unloaded but ready' condition.

I'll have to post some pics...

A locking rack wouldn't be sufficient in a school zone.

                            Section 12026.1
                            (c) As used in this section, "locked container" means a secure
container which is fully enclosed and locked by a padlock, key lock,
combination lock, or similar locking device.
                            I'm learnding.

No. You are confusing 12026.1 which is an exception to 12025 (concealed handgun), with 626.9 (CA school zone) and/or the federal school zone definitions.

                              Edit to clarify:

We are talking about a long gun here. Yeah, 626.9 refers to 12026.x for definition of a locked container, but, 626.9 is applicable to handguns, not long guns.

626.9 (c) Subdivision (b) does not apply to the possession of a firearm
under any of the following circumstances
                              :
                              (1) Within a place of residence or place of business or on private
property, if the place of residence, place of business, or private
property is not part of the school grounds and the possession of the
                              firearm is otherwise lawful.
                              (2) When the firearm is an unloaded pistol, revolver, or other
firearm capable of being concealed on the person and is in a locked
container or within the locked trunk of a motor vehicle.
This section does not prohibit or limit the otherwise lawful
transportation of any other firearm, other than a pistol, revolver,
or other firearm capable of being concealed on the person, in
                              accordance with state law
                              .
Or at least that's how I interpret it. Now, the federal school zone law may have restrictions on long guns, and the lock, but I have not ever researched the federal laws.
