Question: DROS, 10 Day Wait & Shipping

There's a rifle I want to buy in the marketplace, but it's in LA and seller won't ship.

Can I drive down to LA, do the paperwork, come back up to Nor Cal and have the FFL ship the rifle to my home address after the 10 24-hour days? The purpose, of course, is to avoid the cost and time of driving back down to LA.

You can drive to la and pay the seller, have the ffl ship it to your ffl. Then drove home and do your dros at your ffl and pick up at your ffl 10 days later.

The ****storm is what happens if you fail dros, where does the gun go...

The seller would have to go to his ffl and have him send it to your ffl. You would have to pay the transfer fee plus sales tax and dros to the receiving ffl, but there isn't two ten day waiting periods.

The problem is you have to show ID to pick up, and its the responsibility of the ffl that does the dros to do that. Most places won't do this even between their own stores. Like buy a gun at ammo bros in Cerritos and pick up from the store in Ontario.

No, the FFL in LA would ship it to your FFL who would then do the DROS. There would be sales tax though.

I wasn't charged sales tax because it was considered, "used."

I did have 1 question, though. If I had a lower shipped to me, am I required to buy a lock? I told them I would bring one, but I was told that it had to be purchased within 30 days and I need a receipt to prove it.

Is this true?

That has been true for every instance when I bought a firearm.

It's either that or proof of owning a CA approved safe.

There is no regulation that says "used" goods are exempt from Ca sales tax. Most every sale of personal property is subject to Ca sales tax, and it is the responsibility of the seller to collect that tax.

If you FFL didn't collect the tax - especially after the CADOJ started strong arming FFLs to do so - I would assume he isn't going to be in business for very long, or he's going to get a nice bill from the state.

Retail sales of tangible personal property in California are generally subject to sales tax. Examples of tangible personal property include such items as furniture, giftware, toys, antiques, clothing, and so forth. In addition, some service and labor costs are subject to sales tax if they result in the creation of tangible personal property.

Why would an FFL collect tax on an item they didn't sell? For all they know it was a gift.

Which is annoying.

We have a box of locks here. All in their plastic packaging, never opened. Always just got them thrown at his family at NRA dinners and such.

So now we gotta buy even more locks, because the ones we have that are still factory sealed aren't any good. Because somehow buying them within 30 days means they're safer.
