    QUESTIONS ABOUT OWNING A FIREARM

    I WAS WONDERING IF ANYONE CAN HELP ME FIGURE THINGS OUT. I AM 22 YEARS OLD NOW AND WOULD LIKE TO OWN A FIREARM AND START SHOOTING AT THE RANGE. MY PREDICAMENT IS THAT I HAVE 2 FELONY COUNTS AS A MINOR. THESE INCIDENTS OCCURRED SUMMER OF 1999 WHEN I WAS 13 YEARS OLD, I SERVED 45 DAYS IN JUVENILE HALL AND WAS ON PROBATION UNTIL 2004. THE FELONY CHARGES WERE "POSSESSION OF A DESTRUCTIVE DEVICE & POSSESSION OF AN EXPLOSIVE DEVICE" TOTALLY BOGUS CHARGES BECAUSE IT OCCURRED RIGHT AFTER THE COLUMBINE SHOOTINGS BUT REGARDLESS I WAS CHARGED AND CONVICTED. ANYWAYS IT IS COMING UP ON 9 YEARS SINCE THIS INCIDENT OCCURRED AND I HAVE NO CHARGES AGAINST ME SINCE AND ESPECIALLY AS AN ADULT. I AM JUST WONDERING IF ANYONE HAS ANY IDEA AS TO WHETHER OR NOT I MAY BE DENIED FOR PURCHASING A HANDGUN. IF ANYONE HAS ANY IDEA AS TO WHAT I SHOULD DO PLEASE HELP. THANKS!

    Don't forget to seal your records. Remember that the process is NOT automatic when you turn 18. You have to go to the Juvenile Court and request that it be sealed. You fill out a form and show up for a court date (though chances are you'll never have to step foot in the court room).

      The first thing the OP should do is turn off the CAPS-LOCK key. lol

        Also, call the DOJ BoF and they have a form that you can submit and they will tell you if you are eligible or not.... Welcome to the forum..

              Was it some dry ice and a plastic bottle?

              I remember some guys playing around with those when I was a teenager. Science teacher would give out chunks of dry ice to mess with. I saw a news story a few years ago about "carbon dioxide improvised explosive devices." It's sad thinking that those guys would have gone to jail now.

                  I disagree with you. I ran into some trouble when I too was 13. Long story short. Records were sealed, joined the USAF, now work for a PD and own lots of rifles and handguns. My adult record is squeeky clean and haven't even had a speeding ticket. So basically what you are saying is that even young and stupid kids shouldn't be given a break even after they have done a complete 180 and turned their lives around to become productive members of society?

                    I too was molested when I was 13 45David1 and joined the Navy and have lots of guns and rifles and became a productive member of society too...

                      I disagree too, I know more than a few guys who when they were teenagers got stupid non-violent felony convictions for drug offenses (probably could have got off with good lawyers), mainly marijuana but since thne have completely turned their lives around and would make better firearms owners than many guys i see at the range.

                        The main difference between you and I is that you still get molested in the Navy. That is why your names are sewn on the butt pockets of your uniforms right? It is so you can tell who you already had and who you are going to have next, right???!!!

                          First off...
                          Fill out this form and send it with a check/money order for $20 to CA DOJ BoF. Within 30-120 days, CA DOJ will notify you on if you can legally own/possess a firearm.

                          Next...
                          Contact a lawyer about having your juvenile record being sealed. After, you request to have it sealed, it will take 7 years from the date of the request to when it actually gets sealed. So, if you request now, when you are 29 it will be sealed. Getting your recorded sealed is important because certain jobs do look into your juvenile record during your background check for employment.

                          If...
                          After, you send in your Personal Firearms Eligibility Check Application (PFECA) to CA DOJ and they advise you that you can not own/possess a firearm. Resubmit another PFECA to CA DOJ after your juvenile record gets sealed (after the 7 years when you request to have it sealed). If you get rejected again; get a lawyer, pay lots of $$$$$, goto court and see if a superior court judge will expunge your record. If that does not work, then you can never own/possess a firearm in the USA.

                          Finally...

                            That BS. It doesn't take 7 years to seal the record. Once the judge orders the record sealed they will not wait 7 years to do it, what would be the point of waiting 7 years to do a lawful order of the courts? There wouldn't be one. Of course it's not going to be instantaneous and it may take a week or two but that's about the most you will wait. Infact once you get the records sealed you should get a nice printout from the courts stating when the records become sealed and another date (I believe 10 or 15 years but don't quote me on that) your records will become expundged. Once sealed a regular background check by the .gov and PD will show back as negative. Also, save your money and do not use an attorney. It's a very easy process to do. Just contact the juvi court system and they will give you instructions on what you need to do.

                              File a 1203.4 motion to reduce the convictions to misdemeanors and THEN seal the case...


                              I have met people who "were" felons and are now just misdemeanor holders due to the 1203.4...
