    A very vague question...LIBRARIAN needed :)

    A few weeks ago, I mentioned in a thread about my physical therapist coming by the house and noticing my uplula sitting on my nightstand, and, we got to discussing guns...well, long story short

    We went to the shooting range together late last night and he asked me a question that I have no knowledge of whatsoever, but, it sounds like something either the Librarian, or, some other more knowledgable gun member could answer...

    He has a friend who told him that, if, he was to get some sort of a business corporation license, then, he would be able to purchase a AR short barrel rifle, which, im guessing, is something that is not legal here...my therapist asked me if that was true, and, I have no idea...I'm thinking this therapists friend may have been stating that he could get a FFL license, which may entitle him to purchase such a item, but, I'm not even sure how that works

    I told him I would post it up here and see if anyone has any kind of information on such a thing...he mentioned something to do with a loophole, although he didnt know much more about it...im not even sure about the status of owning/buying such a firearm in California

    I would appreciate anything that could be interpreted based on what I've stated

    If you want to summon Librarian you'll have to chant his name three times.

    Is it possible to get the necessary permitting to manufacture or obtain a modern SBR rifle? Yes. But the barriers to obtain those things are pretty high. You'd need to be a federal firearms licensee with a CA dept of justice issued dangerous weapons permit, plus special occupational taxpayer permitting from the feds to deal with firearms covered under the national firearms act of 1934. (You should have seen that sentence before I de-acronymized it).

      In CA...

      Certain NFA firearms (DD, MG, SBR, SBS) require a Dangerous Weapons Permit from CA DOJ.

      BATFE will not approve a Form 1 or Form 4 for any of those NFA firearms, unless the applicant has a valid CA DOJ BOF Dangerous Weapons Permit.

      In order to get approved for a Dangerous Weapons Permit, you need a "good cause".

      Per CA laws [PC 33300], for SBR & SBS there are only two valid good cause statements:
      1. For use as a prop in the movie/tv industry. [PC 33300(b)(1)]
      2. For selling/making/loaning to Gov/Mil/LE agencies. [PC 33300(b)(2)]

      A person/trust/corporation/etc requires one of the above good causes in order to legally acquire/possess a SBR/SBS in CA.

      The "loophole" is becoming a FFL/SOT to make & sell SBR/SBS to Gov/Mil/LE agencies. Because in order to qualify for the other good cause, you need the backings of a major studio (CA DOJ will be checking your references).

      Also, keep in mind, that if you use the dangerous weapons beyond the scope of your good cause statement (such as recreational use or self defense), then CA DOJ can revoke your Dangerous Weapons Permit and confiscate all your dangerous weapons.

      You will also have to pay an annual permit/compliance fee and need to register all the vehicles that will transport the dangerous weapons and register all the locations that will store the dangerous weapons and be subject to annual compliance inspections. Transporting the dangerous weapons in a non-registered vehicle or storing the dangerous weapons in a non-registered locations, is grounds to have your Dangerous Weapons Permit revoked and your dangerous weapons confiscated.



      Penal Code 33300
      (a) Upon a showing that good cause exists for issuance of a permit to the applicant, and if the Department of Justice finds that issuance of the permit does not endanger the public safety, the department may issue a permit for the manufacture, possession, transportation, or sale of short-barreled rifles or short-barreled shotguns. The permit shall be initially valid for a period of one year, and renewable annually thereafter. No permit shall be issued to a person who is under 18 years of age.
      (b) Good cause, for the purposes of this section, shall be limited to only the following:
      (1) The permit is sought for the manufacture, possession, or use with blank cartridges, of a short-barreled rifle or short-barreled shotgun, solely as a prop for a motion picture, television, or video production or entertainment event.
      (2) The permit is sought for the manufacture of, exposing for sale, keeping for sale, sale of, importation or lending of short-barreled rifles or short-barreled shotguns to the entities listed in Section 33220 by persons who are licensed as dealers or manufacturers under the provisions of Chapter 53 (commencing with Section 5801) of Title 26 of the United States Code, as amended, and the regulations issued pursuant thereto.

        Don't forget the candles, the pentagram, and the Islay single-malt scotch....

        I wish I could take credit for minions, but I actually don't know much about that; Dr Rockso and Quiet clearly know a lot more.

            I'll pass along the information, its of no great concern to me, it was just something he brought up while we were shooting...I did a google search on those AR short barrels rifles, they look pretty nice, I could see myself owning one, if possible...I can see the interest
