    Publicly carrying a deactivated firearm.

    Ok just go with me for a second:

    Some one asked me the about the legalities of carrying an actual firearm in public (as part of a Halloween costume no less) but one that had been deactivated; that is for example, mainspring, firing pin, BCG, etc had been removed so that the firearm was incapable of firing, but wasn't permanently altered.

    I have no clue on this one - so I took the field expedient route and told him it was a bad idea.

    But honestly can I get a legal eagle consensus? I can find plenty of references to permanently deactivated firearms, but nothing re: temporarily disabled ones.

    Sounds like a man with a gun call to me, and all the confusion that goes with trying to explain to the police that even though it's a real gun, it really doesn't work....
    How about this? costume guns for costume partys.

      See that's what I thought; why risk the hassle? Just go get a freaking orange tip toy and be done with it.

      Reminds me of the guy that got busted here in San Francisco a couple years back at a Halloween street party - he was dressed as Jason from Friday 13th, and he was carrying around a real chainsaw.

        Wow, even chainsaws are illegal in San Francisco?

            It must be Halloween time again, did you miss Neil's thread from last year? First off, you might get away with a long gun carry this year, but forget about next year, even prop pistols are verboten unless you are from Hollywood. Have you been to Disney Land lately, even the flintlock cork guns are orange now! This is the most insulting thing about CA gun/toy laws....

            I think the consensus from last year was, why bother, just use an airsoft if you want an authentic look...

                Nothing I've read in the civvy carry laws offers an exemption for "deactivated" firearms, so it's probably safe to assume it's not legal. Unless he's in a parade - there's an exemption for that (I think).
                It was not a threat. It was an exaggerated response to an uncompromising stance. I was taught never to make a threat unless you are prepared to carry it out and I am not a fan of carrying anything. Even watching other people carrying things makes me uncomfortable. Mainly because of the possibility they may ask me to help.

                      Last year I open carried a AR-15 with empty magazine...I did have loaded magazines in my vest.

                      No Issues.

                        Some years back, our city hosted Western Days, dress up, holsters, handguns, rifles, all the fun stuff. Of course it was frowned on by a few and never done again.

                        In todays climate, I'd be afraid someone would try to steal the gun from the barer, working or not. If they jump folks for their candy---a firearm would be the grand prize.
