question regarding a trade

So I'm trading my rifle to another member on this forum( I'm so damn excited), I'm trading my Mossberg .22 for his Mosin 91/30. Now, his Izzy is from 1943 and I read that when it comes to guns 50 years or older that you can just do cash and carry for purchases. I'm just wondering: can I do the same for the mosin? Basically what I'm asking is, will I still have to have a 10 day wait for the background check if I'm doing a trade and the gun is 50 years or older? I don't have any problems with a background check(I'm no criminal) but I have plans to go to the range the following week and I would like to take the gun as well. If not, its perfectly fine I can just go to the range once I get the gun but I'd just like to know for future reference. Thanks for any help anyone can provide.

Rifles 50 years or older fall under Curio & Relic and are "cash & carry" -- well, until 2014 when California will make it much safer by registering and DROSing ALL firearms rather than just evil handguns. Crime should totally disappear by mid-2014 and all police departments will be disbanded, freeing up vital funds for illegal alien scholarships.

Yes. Firearm sales must be conducted through a fully licensed California firearms dealer. Failure to do so is a violation of California law. The buyer (and seller, in the event that the; buyer is denied), must meet the normal firearm purchase and delivery requirements. "Antique firearms," as defined in Section 921(a)(16) of Title 18 of the United States Code, and curio or relic rifles/shotguns, defined in Section 178.11 of Title 27 of the Code of Federal Regulations that are over 50 years old, are exempt from this requirement.

If both parties to the transction are California residents then neither party needs an FFL to transfer a 50+ year old C&R long gun.

you're awesome thanks. So essentially, I could walk out the door that day with my new gun but the person I'm trading with still has to wait the 10 day period since the gun he will be receiving is not 50+ years old?

Of course, I would only do so if it was ok with the other member conducting the trade. If he didn't feel comfortable with me walking out the door with his gun and him still having to wait ten days for mine(which I guess technically would now be his) then of course I would be willing to wait the ten days as well.

If the other guy wants you to DROS the Mosin and wait the ten days, ask him to pay the extra $35 it will cost.
