    Can I Sell?

    My uncle gave me a few old guns want me to sell them for him, he doesn't want to come in and out so can I do the transfer when the gun is sold or he has to be the one to sign the transfer paper? Thanks.

    Your uncle will have to do it. You guys could have them all transferred from him to you at an FFL, then you pick them up 10 days later. You can then sell them yourself. But while they are owned by him, he has to do the transfers.

      Not really.... Are they long guns or handguns??? And it's entirely possible for u to sell them for him. It happens all the time when a widow comes to sell her husbands guns

          Under that circumstance, the widow probably is the owner, by inheritance.

          'Doing it correctly' and 'getting away with doing it incorrectly' are different things.

          'Doing it correctly' requires, in this example, that the uncle go to an FFL and start a PPT to somebody. Or, the uncle could give the nephew a nice legal power of attorney to act as his agent in selling the guns.

          Since ownership is not checked, because registration is not required (see the wiki for the long explanation of that -- http://wiki.calgunsfoundation.org/Firearms_registration), 'getting away with doing it incorrectly' is not difficult; it's still a misdemeanor, that could lead to a year in jail.

          Most people would spend an hour or two at a gun store to avoid a year in county jail.

            they are 3 handguns, he didn't take care of them, keep them in the nylon holster so a couple of them has light rust on it.. he didn't want to have anything to do with them anymore so gave them to me.
