    How to legally sell my AK47

    Hello, can some please help me? My dad wants to sell his preban AK47 and we live in CA the rifle is register with the DOJ. I am trying to sell it online with gunbrokers and I want to know the legal steps on how to sell it. Thank you in advance for your reply

    First are you 100% that is a registered assault weapon? aka a RAW
    Just purchasing it before the ban does not make it registered. Your dad would have actually had to send in the form.


    He can not sell it to anyone in CA and I believe that to ship that rifle out of CA it must go thru a FFL with a CA Assault Weapons Dealer Permit.
    Not just any FFL can handle them they have to have the permit.

      Well he has a letter from the DOJ and it is register in 1997 and on the letter it says to call them to let them know if the rifle is sold. I called the DOJ and no one has called me back. Before I try to sell it I wanted to ask them how to do it legally and no one has answer my call.

        I might be wrong but I am pretty sure the registration period was from August 16, 2000 to January 23, 2001. Making the 1997 part questionable.

        I repeat are you sure it is registered as an assault weapon? Ask him to look at the letter and see what it says.

        It could just be a voluntary registration or just his DROS thus making the rifle an illegal assault weapon. If he didn't have it registered as an assault weapon that changes the information we need to give you on how to proceed.

        BTW if it is a RAW you are not supposed to be in possession of it. It is illegal for your father to let it out of his control. He needs to be the one selling it.

          Can anyone please recommend a dealer in the LA area who will facilitate this transaction. So far the only one I found is Martin Retting, but they won't help me sell out of state, only offered to buy it from me. I'd rather not sell to a dealer who will give me a super low price

            It depends on what type of AW it is. Is it a Category One AW" Or, is it just an AW by features? If it's the second, it'll be a lot easier.

                    there is another option, an ugly one, but still an option. you could destroy the receiver and sell the rest of the gun as a parts kit in CA.

                        Never messed with a RAW, but is it actually required you use an FFL to ship out of state, unlike a "normal" firearm?

                              The hassle of selling an AW makes selling an AK almost not worth the trouble. I'm not sure what the value is but in non-banned states an AK does not have the same value as other more desirable guns. What do you think it's worth?
