Yes... there is. A "sniperscope" is illegal, but it's very easy to avoid that issue since it's specifically defined. Basically... just don't get an NV scope with an illuminator attached to the scope/gun.

I have a similar red dot for my Buckmark and it works really well. I don't think you're going to get good results from a shotgun though.

Yes they are legal, I have one similar to that plus a couple others of better quality. Matter of fact, one of my red dot sights was brought to my attention that it was on sale by a LEO friend of mine (we both bought one).
