Here's the deal; I'm online at a gun auction site and find an off roster pistol in California and the guy will not sell it me via a PPT! What's the problem with these guys? They're in California trying to sell someones California gun on commission but they wont sell to a Californian! Some places don't have a problem with this but there are a couple of these places that treat fellow Californians like they're lepers. The pistol in question didn't sell because the reserve price wasn't met. I was willing to pay the full astronomical amount and travel to his location, but NOooooo, he still will not sell it to a Californian because of "All the red tape". What RED TAPE? You still have to fill out a DROS form! It's not Mr. FFL's gun! What's the problem?

The FFL can't PPT it to you as they are not the owner.
They could call the owner in, but that would but their commission in jeperady.

I had the same problem about a couple of months ago. I saw a 586 with box for 425 on gunbroker at a pawn shop in Ontario. I was going to work in the area that day, so I drove there and asked about it. The guy there gave me an attitude and told me he couldn't be cause it was part of the dealers inventory. FUD? Who knows? All I know was that I didn't get the revolver.Comment

If they purchased the gun outright from the owner it cannot be done as a PPT, if it is off list.Comment

I don't see a PPT if both parties are not present at the FFL to do the transfer.
If the FFL has the item logged in as inventory....its now a FFL to you sale ( I do believe)

If it's certain that the seller personally owns the weapon and does not own it under a FFL license, then I couldn't venture to guess why he doesn't want to sell.

I know how commission sales are done because I've done a few. It's not the FFL's gun. It's the Private Party's gun. The FFL is an auction middle man, taking pictures, putting it on the web, doing the DROS PPT, paying the auction site it's fee, blah blah blah, and taking a commission on the final sale price. If it were the FFL's gun they would have bought it from the private party outright and are now selling it (NOT FOR SALE IN CALIFORNIA) like Retting does. There's a place in SoCal that I deal with all the time that is the best at doing this (everything they have is PPT). The Private Party is going to have to sign a DROS sooner or later anyway.
Now back to my main point, where's all this RED TAPE!Comment
