        9th Circuit upholds block on background checks for California ammunition buyers

        The 9th Circuit Court of Appeals ruled Thursday that California’s policy of background checks for bullet-buyers violates the 2nd Amendment, effectively killing a 2016 ballot measure meant to strengthen the state’s notoriously stringent gun laws.

        Writing for two of the three judges on the appellate panel, Judge Sandra Segal Ikuta said the law “meaningfully constrains the right to keep operable arms” guaranteed by the Constitution, by forcing California gun owners to reauthorize before each ammunition purchase.

        “The right to keep and bear arms incorporates the right to operate them, which requires ammunition,” the judge wrote...

        Judge Jay Bybee disagreed.

        “California, which has administered the scheme since 2019, has shown that the vast majority of its checks cost one dollar and impose less than one minute of delay,” the judge wrote in his dissent. “The majority has broken with our precedent and flouted the Supreme Court’s guidance.”

        Data from the California Department of Justice’s Bureau of Firearms show that the program approved 89% of purchases, most within about three minutes. It rejected slightly more than 10% on technicalities that were later resolved, and fewer than 1% because the buyer was banned...

        It was not immediately clear if the ruling would lift restrictions in place for the last six years. California leaders have not yet said whether they would appeal the decision...

        ...In sum, in our Second Amendment cases following Bruen, we have not considered whether challenged laws would be constitutional as applied to the facts of any particular persons’ cases. We have instead considered whether applying these rules would comport with Bruen’s two-step framework without conducting a fact-specific inquiry.

        Here, consistent with our precedent and that of the Supreme Court, we have applied Bruen’s two-step framework in assessing Rhode’s facial challenge to California’s ammunition background check regime. After doing so, we conclude that California’s ammunition background check regime lacks a “plainly legitimate sweep.” Wash. State Grange v. Wash. St. Republican Party, 552 U.S. 442, 449 (2008) (citation omitted). Although California’s ammunition background check regime does not impose the same costs and delays as to all ammunition buyers, the proposed conduct of purchasing ammunition falls within the plain text of the Second Amendment in all applications, and none of the provisions at issue is consistent with the Nation’s historical tradition of firearm regulation. Nor has California shown any applications in which its ammunition background check regime is constitutional...

                Midway, I suspect, is on the ball this time because they sat around last time with their thumbs up their arse. Folks bought millions of rounds, and they just watched all those potential sales go to other retailers.
                Anyone who buys from them is cautioned that their packaging is so bad, that often stuff gets lost in transit. If you ship an anvil in rice paper, expect that.

                    Freedom Munitions is shipping again too. But the best 9mm I could find tonight was $0.27/rd net of shipping and taxes. I was expecting a bit better.

                          As much as I'd like to participate in the transferring of multiple tons of ammunition to CA from the rest of the US I'm still pretty well stocked from before this infringement started. Instead I'll send a few bucks to the CRPA. Without them and several other 2A groups none of this BS would ever get litigated.

                            Same thing for me, I still have stock from an ammo frenzy I had back in 2018-19 I think it was. All of it mailed to home. I had so much I actually sold about 1/3 of it during covid to cover all my costs of the frenzy. I still have some left, but running low now.

                            Great idea about giving to the CRPA. I have done so before, and will be sending them another one.
