.45 colt sale to under 21

    .45 colt sale to under 21

    I was in big 5 today to buy .45 colt ammo. I have done this multiple times at this store. Today i was told i must be 21 to purchase this handgun ammo. I dont own a handgun that shoots .45 colt. I have a rifle that shoots .45 colt. Whats the classification for .45 colt in this state for selling to persons under 21? IIRC the .45 colt started out as a rifle cartridge that could also be used in revolvers so the hunters/soldiers/cowboys only needed 1 ammo type.

    I don't know what the ammo started out as, but as long as it is for your rifle you are legally able to buy it at the age of 18.

      They are right in not selling it to you.The 2008 Danderous Weapon Control Law chapter 2.6 # 12316 b states that it is illegal to sell ammo to a person under 21 that can be used in a pistol or a rifle.

        As a person that is 18-20 years of age, you need to convince the seller that the ammo is for use in a rifle.
        Because by law (Fed & state), they need to believe it's going to be used in a rifle for them to legally sell it to you.

        Federal law [18 USC 922(b)(1)] prohibits a dealer in selling ammo that is not for a rifle/shotgun to a person they believe is under 21 years of age,
        CA law [PC 30300(a)(2)] prohibits a dealer/person in selling ammo designed and intended for a handgun to a person under the age of 21. However, if the ammo can be used in both a handgun and a rifle, it can be sold to a person 18-20 years of age, if the seller believes the buyer is acquiring it for use in a rifle.


        .45Long Colt started off as a revolver cartridge. Lever action rifles were later made to chamber it.
        .44-40 started off as a rifle cartridge. Revolvers were later made to chamber it.



        Penal Code 30300
        (a) Any person, corporation, or dealer who does any of the following shall be punished by imprisonment in a county jail for a term not to exceed six months, or by a fine not to exceed one thousand dollars ($1,000), or by both the imprisonment and fine:
        (1) Sells any ammunition or reloaded ammunition to a person under 18 years of age.
        (2) Sells any ammunition or reloaded ammunition designed and intended for use in a handgun to a person under 21 years of age. Where ammunition or reloaded ammunition may be used in both a rifle and a handgun, it may be sold to a person who is at least 18 years of age, but less than 21 years of age, if the vendor reasonably believes that the ammunition is being acquired for use in a rifle and not a handgun.
        (3) Supplies, delivers, or gives possession of any ammunition to any minor who the person, corporation, or dealer knows, or using reasonable care should know, is prohibited from possessing that ammunition at that time pursuant to Chapter 1 (commencing with Section 29610) of Division 9 of Title 4 of Part 6.
        (b) Proof that a person, corporation, or dealer, or his or her agent or employee, demanded, was shown, and acted in reasonable reliance upon, bona fide evidence of majority and identity shall be a defense to any criminal prosecution under this section.

        18 USC 922
        (b) It shall be unlawful for any licensed importer, licensed manufacturer, licensed dealer, or licensed collector to sell or deliver—
        (1) any firearm or ammunition to any individual who the licensee knows or has reasonable cause to believe is less than eighteen years of age, and, if the firearm, or ammunition is other than a shotgun or rifle, or ammunition for a shotgun or rifle, to any individual who the licensee knows or has reasonable cause to believe is less than twenty-one years of age

            why are you buying ammo at big5? Their prices usually suck. There has got to be somewhere else that would like to have your business.

                Not when .45 colt is on sale in addition to having 15% off coupon. And closest place for cheaper ammo is an hour away. (bass pro) i live in alameda county, walmart doesnt sell ammo in this craptacular county. Their .410 ammo is also cheaper than most too

                      They do, but they are pretty picked over all the time. That and I have never seen .45 colt there before, just the "popular" calibers. Ask Bullseye Castro Valley if they have any. If they don't they might be able to point you in the right direction
