    Family transfer?

    My step dad passed in February and I don't want my mother living alone in BFE Illinois so she is moving in with my wife and I in SD. In late November I'll fly to Illinois and drive her to our home in SD. Including her guns and my father-in-law’s guns. The guns she wants to keep, or pass to me, I think she should fill out New Resident Report of Firearm Ownership . Can she complete this with non-california license?

    But what about the guns she nor I want? If she includes them in the above form, when it comes time to sell them, will the non-california license be an issue? Should she just transfer them all to me and I can keep what I want and then sell what I don’t?

    The firearms became your moms when her husband dies. If you want to do everything by the numbers, She moves to California with them and fills out a New resident firearms report that will register them to her, the legal owner. After that she is free to sell them (after she gets a California ID or License) or give them to you upon what time you would fill out an Intrafamial transfer form to legally register them to you.

      Its the license thing. She will not get a California license, wants to maintain her Ill residence. She will living with us in SD 85% of the time but still living in Ill. Just wondering if the paperwork will work if she doesn't get a california ID.

        She can not fill out a New Resident form if she doesn't have a Ca issued ID. She can not sell any of them without a Ca ID also. The guns being transferred to you since she is not going to be a Ca resident have to be done at an FFL as a dealer transfer. Since she will be maintaining residency in IL federal law requires that the guns be transferred to you through an FFL, as you are residents of different states.

          also, what’s this about you living in SD? San Diego or South Dakota?

              Keep in mind that the FFL can charge you whatever fee they want to do the transfer. It is not locked in to $10 like a PPT. Also make sure that the dealer will process a walk in transfer before you show up. It may be in your best interest to call around find the lowest transfer fee, and determine that they will do the walk in transfer. Stick with a LGS, big chain stores are not going to be your friend here.

                If some of the firearms are antique or C&R, those can be handled differently than the modern firearms. If so, in your case, having a 03 C&R license could be to your benefit both now and in the future.
