    20 years for a warning shot??!!

    20 years for a warning shot... I admit a warning shot has its legal troubles but dang!

    From CNN...

    Saying he had no discretion under state law, a judge sentenced a Jacksonville, Florida, woman to 20 years in prison Friday for firing a warning shot in an effort to scare off her abusive husband.

    Dupe, but yeah ,she blew it by leaving then COMING BACK.

    It was the coming back then shooting part that made HER the aggressor. Stand Your Ground was not in play for this one.

            We have a 10/20/life law here.

            Mandates a minimum 10 year prison term for certain felonies, or attempted felonies in which the offender possesses a firearm or destructive device
            Mandates a minimum 20 year prison term when the firearm is discharged
            Mandates a minimum 25 years to LIFE if someone is injured or killed
            Mandates a minimum 3 year prison term for possession of a firearm by a felon
            Mandates that the minimum prison term is to be served consecutively to any other term of imprisonment imposed

              When I get elected POTUS, and I push my "Rob's 21st Century Extension to the Bill of Rights" one of the new constitutional amendments will be:

              11. "Recognizing that laws are made by men, and therefore fallible, no law will ever be able to account for all possible circumstances under which it will be enforced. As such, neither the federal government, nor the state governments, nor any local government shall pass a law under which the judicial system has no flexibility to account for exigent circumstances or application of the law which conflicts which the interest of the people."

              Or something to that affect anyway.

                I am not sure if Nathan is agreeing with me or not. I do like specific sentencing.

                Of the top of my head, it sounds like this woman got overcharged and convicted.

                I think George Zimmerman got overcharged, and as a result will be acquitted.

                These things happen. The thing that bothers me the most about Florida is that is really flat and most of the people who live there seem to be from New York. Not like my neighborhood.

                    I am one to think that a warning shot is a terrible idea. It is an aggressive stance, if you truly feel in danger, shoot the perp, and deal with the courts. With the way courts are, a warning shot can be interpreted as I was not in danger, thus a brandishing a weapon charge might happen, leaving the supposed bad guy the opportunity to claim they acted in self defense to your aggressive stance. If you feel your life is in danger enough to warrant killing another, shoot to kill. If you shoot to injure/maim or fire a warning shot, it can be argued you truly did not feel in mortal danger.
                    and coming back to the scene and doing so does make you the agressor.

                      If she was really in fear of her life she wouldn't have walked back in the place and confronted him. 20 years seems excessive, but I'm not surprised by at least some kind of conviction.

                          Odd here in Kalifornia my dumbass brother in law shot a gun in the air arguing with his gf. Nothing came of the issue the police only took the gun. Wasn't even his gun was my father in laws they do live on a farm though.

                              Lol it's funny the comments that she should've came back kinda like Dbag Zimmerman should've kept pursuing the kid when told not to by the 911 operator! So yeah I'm sure race does have a factor but then again then is Calguns where the you fill in the blanks run a mock.... Bahahahahah
