Whoa, shot at someone with an assault weapon? Wobbles to felony, I think.

Any good criminal defense attorney. These charges don't require a gun law specialist. My advice would be to go with the PD. Failing that (some people are politically biased against PDs), I would try Steven Clark of San Jose; he's very very good, but probably not cheap. He may also not be willing to take a "boring" case (for example if the defendant really did the crime and the evidence situation is pretty clear), which would be better served by a simple plea deal and some negotiation.

246 is discharging a firearm at an "inhabited dwelling place" currently being used whether someone is in there or not. 30605 is using an "assault weapon".

This could range anywhere from a drive by shooting at a house with an AR to getting caught causing bullet holes in a cabin out in the woods with a 15 round 22LR due to careless backdrop target shooting.
