      I understand your reluctance to leave negative feedback but it is warranted in this case. That is just plain ugly. Out the villain!!

          OP,
          Hard to say the original owner even knew that there was a problem for sure, some people aren't very mechanical, observant or smart.
          Buying used, sight unseen, is risky and the buyer has to assume some responsibility for his actions too. If you don't want to assume this risk, buy NIB with warranty.
          If you transferred face to face, you should have looked the gun over more carefully.
          Is the sight damaged? Absolutely. (34 years professional machinist/tool and die maker speaking here).
          If the seller knowingly sold you damaged goods, he'll get his in due time.
          Be thankful it is a relatively inexpensive part and easily changed out.
          If I were the seller, I would at least offer to goes halves on a new rear sight.
          If I were you, I'd bite the bullet and chalk one up for experience.

          Now PLEASE don't tell me you believed him when he said it only had 100 rounds down the pipe

            Playing 'devil's advocate'- he could also claim you damaged it by removing it.

            I'd just eat the sight and learn from the experience. You will look over future purchases much more carefully.

            In small claims law, if it's an externally visible defect (like bald tires on a used car), it's the buyer's responsibility to see it.

            Doesn't mean if the seller's cool he shouldn't kick you back 20 bucks.
