    Dual Residency Oregon ID

    Ok, first off, I am not asking these questions because I want to find a "loophole" to import certain firearms into CA. I am asking because I would like to keep some CA evil toys in OR.

    1. I own a property in OR that is my residence for a portion of the year (a portion may be rented out or lent to friends and family when we are not there).

    2. I have a vehicle on the property registered and licensed via the OR DMV.

    3. I think it would be misleading to apply for an OR license because I do not live there 6 mos of the year.

    4. By OR law I am allowed to purchase firearms in OR while "residing" there even if temporarily.

    Applicable Oregon law regarding Identification:

    (4)(a) Identification required of the purchaser under subsection (2) of this section shall include one piece of current identification bearing a photograph and the date of birth of the purchaser that:
    (A) Is issued under the authority of the United States Government, a state, a political subdivision of a state, a foreign government, a political subdivision of a foreign government, an international governmental organization or an international quasi- governmental organization; and
    (B) Is intended to be used for identification of an individual or is commonly accepted for the purpose of identification of an individual.
    (b) If the identification presented by the purchaser under paragraph (a) of this subsection does not include the current address of the purchaser, the purchaser shall present a second piece of current identification that contains the current address of the purchaser. The Superintendent of State Police may specify by rule the type of identification that may be presented under this paragraph.
    (c) The department may require that the dealer verify the identification of the purchaser if that identity is in question by sending the thumbprints of the purchaser to the department.
    Using my passport ID would qualify as photo ID, would not show my address, but would show that I was born in "Portland, OR" asside from being a atypical form of ID it should not raise any, "hey this guy is from CA" flags. I could use my DMV registration, checkbook, utility bills from an OR residence as additional identification and proof of address.

    What do you think, I know I could do private sales in OR face to face, but do you think this would fly with an OR FFL? I guess I could post this in FFL but seems more general....

    Oregon has very lax residency requirements. even though i am temporarily living in CA to finish school, i still maintain my Oregon residency. Basically from what i have read about residency requirements in OR i can be away as long as i want and can continue being a full time "resident" so long as i am planning to return (which i am when i finish school).

    my recommendation is that you contact the Oregon DMV or go to their website and see if you can get an oregon ID card (not a driver's licence, just an ID with your oregon address.) that oregon ID card will allow you to buy guns in the state of oregon. great thing about OR is the DROS takes 10 minutes not 10 days. CASH AND CARRY!!!!!!!!!!!

      First let me say that I am not an expert but I have a good dose of common sense. I have a house in California and a house in Arizona. I have established my primary residency as being in California, this is where I vote and pay taxes. I have an Arizona ID and a California DL. You can only have one DL at a time.
      I would never purchase a gun in AZ but when in AZ I follow AZ gun laws, much less restrictive than CA.
      I think it is a bad choice to claim you live in one place, when your main residence is somewhere else. A lawyer would be the better judge of the legalities but a quick review of the facts may make your claim of dual residency less than truthful, IMHO.

        The law states that you may purchase firearms while temporarily residing in that state. What seems to make it tricky is the ID issue. It is not like I want to get a new license every six months.

        So the problem seems to be with ID not the legality. Anyone in OR that's sees your CA DL is going to have a knee jerk reaction, even if you have legal temp residence. And all DMVs seem to have a problem issuing ID when a valid ID is still maintained. I don't know how AZworks but it is pretty clear that OR would require forfeit of CA DL even to get an OR ID card...

          Post this question on NorthwestFirearms.com. This is the CGN equivalent for OR and WA.

          That being said, FTF transactions with OR residents usually require cash only. However, most sellers prefer you sign a bill of sale, present your ODL and OR CHL. For FFL's, you may get by. IANAL, only speaking from experience.

            so i checked the Oregon DMV website and it looks like i was wrong about being able to get an Oregon ID card. it would require you surrendering your CA DL. so i withdraw my previous statement.

              I have my Oregon DL and my California DL, both are still active. I don't use my OR DL for anything, it sits at home. When I moved back to CA I still had my CA DL and they never asked for my OR DL.

              I'm interested to see what some other people have to say about this. I know CA doesn't want you buying guns in other states, but if you live in that state, CA should have no say over what you do.

                  I have the same thing. I wouldnt buy guns in Oregon, cause I am not a resident there anymore. If I was there part time, I would keep my CA DL, get an OR ID and buy all the guys I wanted.

                  The ATF has a good guide on this subject you can look for, its straight forward and simple. There are also many dual residents here on CGN. The problem is not wether or not you can legally purchase firearms with two residences, you can. There's no question about it. The problem is getting the proper ID. As someone pointed out, OR will not give you an ID if you have a valid DL from another state, I am not going to comment further...

                  Oregon does have a provision that says simply owning property in OR does not justify residence. You have to spend part of the year there. The ATF definition of a dual resident is straight forward enough, but does have some vague language. If there was a question (youre gun ended up at crime scene etc...), an unlikely event by all accounts, you may have to prove that you do indeed have a residence, and spend part of the year there, but I am just speculating.
