    Intrafamilial Transfers

    Hey guys,
    Ive done searches and read the wiki, but I cant get me head around this concept. My dad owns a CMMG AR-15, and he wants to give it to me. how would he do this legally?

    Is it a registered 'assault weapon' (RAW)? Then no, can't legally transfer it in CA to anyone but a licensed FFL with AW permit.

    Is it on the list, but NOT registered? Then NO NO NO NO NO!

    Is it an OLL, whether features and magazine-lock or featureless? Then it's just a rifle - 'Here, son, have this nice rifle' and you're done.

      I'll just add that both you and your father need to be California residents for a transfer like this to be legal, unless you want to go through an FFL for the transfer. The "intrafamilial exemption" is only an exemption to California's dealer transfer requirements. The Feds still have an FFL transfer requirement for transfers between residents of two different States.

        Assuming dad lives in another state, he sends said legally configured rifle to the FFL of your choice.

        My parents have given me two handguns over the years (they live out of state). Shipped them to my FFL (Fort Courage Armory) I started the DROS process and picked up ten days later. Make sure they send a note that it is a gift from father to son so there is no question who the gun is coming from (IE dont get charged tax).
