    CA Automated Firearms System Record Request

    CA Form BF 053 - is in violation of the United States Code, Title 18, Part 1, Chapter 33, Section 701.

    On the top of the form it requests that you "include a photocopy of a valid identification card (driver's license, Department of Motor Vehicles or federal/state prison identification card)."

    I am currently in receipt of a memo from the Office of the Assistance Secretary of Defense - Reserve Affairs, dated 27 October 2011 which states that "the photocopying of US Goverment identificiation is in violation of United States Code, Title 18, Part 1, Chapter 33, Section 701 and punishable by both fine and imprisonment."

    Since this is a violation of the US code, how much ummmppfff will this play on the state AG office? I'm not sending the military ID copy but will be sending them a copy of my CDL, along with a copy of this letter from the feds so the state can get it's act together. But only after I complete my DROS on my latest purchase - Rem 870.

    What are some of your thoughts?

    Sec. 701. Official badges, identification cards, other insignia

    -STATUTE-
    Whoever manufactures, sells, or possesses any badge,
    identification card, or other insignia, of the design prescribed by
    the head of any department or agency of the United States for use
    by any officer or employee thereof, or any colorable imitation
    thereof, or photographs, prints, or in any other manner makes or
    executes any engraving, photograph, print, or impression in the
    likeness of any such badge, identification card, or other insignia,
    or any colorable imitation thereof, except as authorized under
    regulations made pursuant to law, shall be fined under this title
    or imprisoned not more than six months, or both.

    I don't think this statute applies to state issued ID's like DL's as it states "for use
    by any officer or employee thereof".

    I know several places that copy DL's, like when you buy a cell phone, or large amounts of fertilizer at the feed store (I used to work on farms). The BATFE itself advises us it is a good idea to copy a DL for 4473's but it is not required.

    EDIT: you are correct never copy your CACS card.
