Help with getting ripped off (not on this forum)

    Hello guys,

Long story short - about a year ago I bought an expensive rifle from a member of another forum who had the listing on several forums. According to the details, the seller told me it had a Jewell trigger.

Got the rifle and checked it over but put in my safe. Now I am just getting around to shooting the rifle and I have trigger problems after firing 3 rounds. Take the action out of the stock to adjust it and realize it has a Shilen trigger - not the trigger the seller said it had and in my opinion, not as good of a trigger as the Jewell. This particular Shilen trigger is also defective and is no longer useable.

The rifle is now with the smith who built it (a great guy) and I have had to buy a Jewell trigger for it.

I contacted the original seller via e-mail about the problem and got no reply. I have his name, number, e-mail and address.

I've never had a problem like this before and was wondering what is the best way to go about this? I want the seller to reimburse me for the Jewell trigger that I've had to buy (which he said originally came with it). I've bought and sold lots of rifles, components, etc. and have never had one problem...

      Agreed.

I would understand a month or two... MAYBE. But a year....

I'm with the other two posters. A year is a long time. Put the shoe on the other foot. If you had sold the rifle and get contacted a year later...wouldn't you be a little skeptical?

I Have to agree. You wont win in court since its been a year. If I was the seller I would not reply either. But then again I sell what I list and tell the buyer of any issues.
              its a lesson learned.
Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.

Playing devils advocate: is it possible the seller was unaware of the rifles trigger? Perhaps if he was not the original owner he was simply passing along information he had been given. Also, is the seller someone who should have been aware of the difference? I.e. a dealer, store owner, etc.?

When buying from non-professional sellers, do your due diligence before, not after the sale.

Hey guys thanks for the replies.

Yes I agree with the fact that it has been a long time. BUT does that negate the fact that he misrepresented what he sold me?

I had no reason to not beleive him and didn't have a reason to take it out of the stock to look, I only did so when the gun malfunctioned.

I have it in email and also in web archive/screenshot of the sale in which his username explicitly states the details of the rifle.

As far as being skeptical if this happened to me. Not at all as I would never misconstrue the details of a $2,200 rifle...but then again I'm a meticulous seller/buyer, not just a "hope it works out" guy.

not trying to be a smartass but perhaps your definition of "meticulous" doesn't match my own; a year is a long time to get around to inspecting what you purchased, especially if the trigger assembly was a purchase point for you.

Just move on. You aren't going to get anything out of him an entire year later.

Yea I should have inspected it but I didn't think that a different trigger than what I was told would be a problem.

Next time I'll rip everything apart the second I get I guess.

I'll still try and get money out of him, no hurt in trying.

It goes to show you that in most transactions the average person is not going to tear something down to verify an advertised component. Kind of like a seller stating that the 69 Camaro has XYZ internal motor mods.

Unless something were to break and need replacement the buyer would never know and likely have no recourse over time. Comes down to the fact that there are always going to be those that mislead and will try to pull one over on anyone they can (unless the seller wasn't aware) but doubtful if he was the original owner.
