    Question regarding FS thread and rules pertaining to it.

    My reply to the FS post got deleted anyway so here it goes.

    Pistols for sale with a $$$/OBO. I sent a PM with offer (not a lowball offer, a reasonable offer). Seller replies to me saying I'll have first dibs on my offered price but he has 2 other PM's so he has to see what the other 2 offers possibly are...meaning he has 2 PM's, not 2 offers.

    Isn't he basically auctioning off to the highest bidder? I'm not trying to put the seller on the spot (my reply got deleted so you can't see which thread anyway). And I KNOW he has the right to sell it to whoever he wants even at a lower price but I'm just wondering how the rules pertain to this situation. The seller has actually been pretty cool so far.

    I don't know. I'm not an expert but it seems like if you check your inbox and you have a PM saying I'll take it at a lower price than you offered, and a PM that says I'll take it at your price, regardless of the time it seems like the higher one gets it. Like, with haggling, the instant someone accepts the other's price, it's a deal. If they accept your first price, that's SPF practically, but if they don't accept it, it's not SPF because you have to accept their offer, putting the lower one behind in time. Just how I take it.

    I think what that rule is prohibiting is the seller saying to you, "Hey, _____ is offering $_. You willing to beat that?"

      Thanks mrkam. What I'm saying is that according to his PM back to me, he has no other offer and just waiting to see if he gets higher offer.

      He said I have first dibs at my offered price which from what I understand is that he would take my offer...

        Well, it says, "While this means you are willing to entertain offers it is NOT a license to auction, neither does it mean that it is acceptable to take a higher offer after you have agreed to a price and a deal." (Emphasis added)

        If he said, "Yes, I'll sell it to you.... oh wait, nevermind, I just got a better offer," then I think that would be not ok. If he says, "Hmm, I might take your offer, but I'd like to get more money out of it. No deal yet, but I'll keep you in mind," then that might be ok. Again, my just thoughts.

          He has other people asking questions. getting clarification and he is not obligated to sell it to you unless you are offering full price.

            Nope. You offered a number lower than what he was asking; he has no obligation to sell to you.

            If he wants to wait a couple of days to see if someone else is willing to pay the asking price, that's up to him.

              Yup, if you had said "I'll take it." at price, then you MIGHT have a beef.

              And I've been burned by the above - seller ( a MEMBER HERE ) said he sold it off site. I bid quickly - he said it was mine, and then doofas says, he had a bid before mine.

              I'm sure he realized his price was a few dollars too low - arghggh, it still irritates me. But it's the web.

                Doesn't sound like he took your offer at all. Sounds more like your "Dibs" was that if your offer was the highest and others made the same offer then your offer was first in line.

                  If the seller has something listed for $1000, you offer $980 and he has 2 other PMs then he is not auctioning anything off if one of the people agree to his asking price or agrees to a higher offer then yours. If he gets one of the guys to agree on asking price and then replies to you that someone is offering the full $1000 but he will put you first if you give him $1010 would be considered a violation.

                    Ur offer below his price is really an invitation to make a deal, he can wait to see if someone offers his asking price. I dont think that qualifies as auctioning, since that would mean start at one price and sell to highest bidder. In this case, he has a right to wait as long as he wants to see if someone offers his asking price obo.

                    Ive been let down by two calgunners that we agree on a deal (full price) and they flake last minute. One occasion i was halfway to palmsprings before he calls and tells me someone stole a plane. Cant sue em, it sucks, but no recourse.
