    CA DOJ Appoverd Gun Safes.

Recently, I went through a weapons transfer (Currently going through it's 11 day wait). The weapons transfer (xfer) is between family (Sibling to Sibling). Trying to do the correct thing, I started asking a lot of questions to the different dealers in my area. I kept getting different responses from each dealer. Some answers were just way out in left field, others a little closer to home.

When I bought my previous weapon, I bought a DOJ approved Gun Safe. After the 11 day wait, all I had to do was show the Model and Serial number of the DOJ approved safe. I had to fill in the blanks on the DOJ compliance page that I signed it, that was it. Now going through this weapons xfer the dealer, I went through the xfer with, wants me to provide them with the receipt of my approved safe also. Is this necessary?

Does the law or regulation state that I need to provide the receipt also or should I be giving the dealer the model and serial number only. On the DOJ compliance page that I have to sign, It only asks for the Model and Serial number. I can show the receipt, That's not a problem. Do I really need to??? and is this person/dealer not knowledgeable about the regulations.

I'm really disappointed that the people who should be in the know gave me so many different and conflicting instructions/answers. And it seems that they don't really know and should. In some cases, the answers varied from person to person in the same stores.

I know it's up to me "the consumer" to make my self knowledgeable about this situation. So where can I look up this information? I've been to the CA DOJ website, and am wading through the pages of links on their website. But for some reason I can't seen to find the info regarding a DOJ approved Gun Safes. Any help would be appreciated.

    Thank you

See the wiki for the long answer -- http://wiki.calgunsfoundation.org/in...es.2C_and_Laws

There really isn't a 'short' answer when CA gun law and Federal gun law intersect.

Go to this website for the affidavit form. Is this the form you filled out? That's all I did and it was accepted by the gun store.

Thank you for the quick response.

So it looks as if, based on what I have read, the Dealer is required to ask for proof of purchase (A Receipt). Not only the Model and Serial#. Based on what I have read on this link. http://wiki.calgunsfoundation.org/in...es.2C_and_Laws

On the previous 2 weapons, all I had to do was fill the form which asked for the model and Serial#. I was surprised that I was asked to provide a receipt this time.

        Thank you for your help.

        California Code - Section 12088.1

(d)The sale or transfer of a firearm shall be exempt from subdivision (a) if both of the following apply:

(1)The purchaser or transferee owns a gun safe that meets the standards set forth in Section 12088.2. Gun safes shall not be required to be tested, and therefore may meet the standards without appearing on the Department of Justice roster.

(2)The purchaser or transferee presents an original receipt for purchase of the gun safe, or other proof of purchase or ownership of the gun safe as authorized by the Attorney General, to the firearms dealer. The dealer shall maintain a copy of this receipt or proof of purchase with the dealers' record of sales of firearms.

(e)The sale or transfer of a firearm shall be exempt from subdivision (a) if all of the following apply:

(1)The purchaser or transferee purchases an approved safety device no more than 30 days prior to the day the purchaser or transferee takes possession of the firearm.

(2)The purchaser or transferee presents the approved safety device to the firearms dealer when picking up the firearm.

((3)The purchaser or transferee presents an original receipt to the firearms dealer which shows the date of purchase, the name, and the model number of the safety device.

(4)The firearms dealer verifies that the requirements in (1) to (3), inclusive, have been satisfied.

(5)The firearms dealer maintains a copy of the receipt along with the dealers' record of sales of firearms.

"other proof of purchase or ownership of the gun safe as authorized by the Attorney General," is the Safe Affidavit form.

I can't count how many times gun shops told me to "put whatever" down on the safe affidavit (acual calguns vendor FFLs) they would say copy a name of one of our safes were selling, or just make up a name.

Although I own my own safe, the paper is like an honor system and by filling it out is a sworn statement of the truth.

Also I've never been asked for a reciept for my gun safe, that's where the affidavit kicks in like mentioned.

Only time needed for a reciept is when you say you bought a cable lock in the past 30 days

I've purchaced a rifle and shotgun within the last year and I only had to fill out the form and sign it. I'm sure there's a "purjory" clause of some type making it an affirmation of truth.

I've never had to provide a receipt.
