    Another Hi-cap question

    Is it legal for my brother, from out of state, to bring in some of his legally owned hi cap mags to shoot out of my guns, here in Ca? If so, would it be legal for me to use them also?

    No.

    Importation is specifically forbidden. Doesn't matter if you are a CA resident or not, you cannot import them unless you are specifically exempted (FFL w/ permit, armored car co., etc).

      That is considered importation. That is where he is breaking the law. Intent is not a factor. Go visit him and take you guns so that they can use standard capacity mags. I take my guns to Vegas from time to time. Just remember what happens in Vegas stays in Vegas (literally) I have a friend in NLV who lets me use part of his garage.

          Isn't there an exemption for importing hicaps for matches like "Steel Challenge" at Lake Piru. Who would come from out of state if they had to shoot 10 rounders in their race guns. Mark

            IIRC if you're passing through or going to a sanctioned shoot you're allowed to bring them.

                Did your brother live here previous to 2000?

                If he did did he own those magazines prior to 2000 ?

                Its my understanding that if he did possess those magazines while living in California previous to 2000 then it is legal for him to return with them.

                If someone thinks im mistaken in this line of thought please provide law as to how im wrong.

It is perfectly permissible to bring them in for sanctioned shooting competitions. Unless all these folks are breaking the law.......

                        PC12280(p) provides an exemption for assault weapons to be used in competitions and makes no allowance for high capacity magazines. The way the section is worded, it is unclear that it covers the entire trip into the state, to the match, and exit, or if it ony covers direct travel from the border, to the match, and immediately out.

                        Unless the magazines (or ones which they replaced) were in the state before Jan 01, 2000, they are likely all breaking the law. (unless i missed something, so please correct me if I did)

                        ETA: It might be possible that they have high capacity magazine permits for their competitions. Otherwise, I'm not finding any exemptions.
