Another Open Carry Stop in Livermore

Walter Stanley was approached by an officer at a local starbucks to perform a 12031 (e) check. I don't want when part 2 is going to be uploaded or if it's going to be uploaded. Here you go.

Is it me or the guy in the video is so annoying?

the guy in the video is annoying.. just his voice.. an maybe its me but if the first officer walked up on me an started asking question why not just tell him the little spech an then tell him your standing so he can remove the gun an inspect it.. but the way this guy is doing it three officers are being pulled out of other calls.. where maybe some is in serious need of help.. ??/ just wondering if you agree or disagree..

Interesting video, thanks for sharing. I do not open carry, but when dealing with Police I tend to be a little less confrontational... but open carrier is well informed. did a pretty decent job with the exception of not shutting mouth after invoking the 5th. I pretty much say what I have to then stop talking.

Walter has been a target, of sorts, by the Livermore PD for a long time. He is an avid UOC proponant, and carries regularly. He has been stopped numerous times for an "e" check, by the same officers who know and address him by name. Not uncommon, is for other officers to have drawn their weapons and held at the ready, despite Walter never giving them a reason for such an aggressive response.

It used to be sad, now it's funny they waste so much time and manpower on a law abiding citizen going about his legal business while complying with state law.
"A nation can survive its fools, and even the ambitious. But it cannot survive treason from within. An enemy at the gates is less formidable, for he is known and carries his banner openly. But the traitor moves amongst those within the gate freely, his sly whispers rustling through all the alleys, heard in the very halls of government itself...A murderer is less to fear. The traitor is the plague."......Cicero

                Interesting contact.

I've been interested in Livermore ever since they lost evidence in the theft of my uncles guns.
We knew enough to give the police a name, whom they found with stolen property, and they lost the guy's prints from off the gun case.

@ 4:26 he should have said "arrest me or go away".

Thanks for posting the video safewaysecurity!

I am the open carrier in the video. My name is Walter. Although some of my friend's here on Calguns might consider my tactics to be confrontational, in all actuality, I'm simply setting the record straight that I would prefer that the intrusion not take place. I believe this to be important, so that officers don't mistake my compliance/non-resistance as implied consent for the unconstitutional search/seizure of my person/property (PC12031e) to take place. Regarding my comment's after invoking my right to remain silent, this was primarily to obtain an understanding of what the officers planned to do, and what they knew about me personally. Originally, I assumed the motor unit that walked in was a supervisor. When he didn't seem to react in any way, I wanted to know the next step. Asking if we were going to just sit there and stare at eachother, who is the sgt on duty, am I free to go, seemed fitting to me at that time.

As some individuals have already pointed out, I am known by the LPD. I have formed a relationship with their command staff, as well as, officers out on the beat through numerous phone conversations, e-mail exchanges, contacts involving open carry and Public Records Act requests. For the most part, I consider the relationship to be a positive and beneficial one. This is not to say that it came easy though. Lets not forget that at this time last year, LPD officers were pulling out rifles and taking up protective positions behind buildings when responding to open carry, not to mention illegally searching for and running serial numbers. Looking back, I don't regret any of the tactics I have employeed in the past and I consider it now to be a more friendly environment for gun owners and open carriers alike within the City of Livermore. In fact, LPD officers are now beginning to drive by and wave at open carriers, as opposed to stopping and attempting to perform 12031 e-checks. I see this as a victory. I believe this is the way it should be!

The real problem is the LPD's open carry policy and what it is lacking. While it is almost identical to Sunnyvale's and Newarks, it fails to include the all important "Roll of the Officer" section, which for obvious reasons should be included.

I will upload Part 2 in a bit. I look forward to your comments. Take Care, Walter

By the way... here's an article that was written by a reporter that just so happened to be present in the coffee shop during the encounter. There is additional video, which shows a portion of Part 2.

I love how they just stare at you blankly as you are schooling them on the (e) check. They had to wait for a supervisor to check if the weapon is loaded Looking forward to pt 2.
