FFLs -"gift" question

When filling out the paperwork, there's a line that asks if this is a gift, presumably for someone else. How does that affect the transaction?

On the 4473 it asks if you are the actual buyer of the firearm, which lawfully includes you even if you are buying the gun as a gift for someone else.

Even in the clarification statements in the back of the 4473 it clearly states that it is lawful to purchase a firearm for someone else as a gift, and that is not considered a straw sale.

So if you are purchasing a firearm as a gift for someone else, you would legally be able to answer "yes" to the question asking if you are the actual buyer of the firearm.

Best thing to do is take the person that you want to buy the gun for and have them do the transfer into there name. Give them the cash so it looks as if they are buying it for them self's. It's a no no to buy a gun for someone else.

Post 2 says it is lawful to buy a gun for someone else as a gift, which is why it asks that on the form you fill out.

Depends. If it's for a friend, then yes, you would have to go back at some point and transfer it to their name.

You could take possession of it, wrap it, put it under their Christmas tree and all that jazz, but you would still have to go to a store and get it lawfully transferred them before 30 days is up (in that time it can be considered a loan, which is also lawful).
