I made one claim, not many. Yes I was wrong. Seriously, I'm the only one who ever thought that there was a five round limit? And honestly. What the heck are you guys shooting at that won't die after five rounds? Is your scope dialed in?
    See? I kid. I kid.

    Lighten up.

    OP,
Sorry I derailed your thread. I truly am grateful you got your gun back.

What were to happen if he refused to surrender his weapon knowing that it is completely legal to posses?

Also, post #42 alludes to other confiscations, which I am not aware of.
The "other confiscations" are not from the OP... they have been from other Calgunners, including Stan from OC, and there was a "hijack" in the "how not to get arrested for your OLL" from someone who's son had their AR taken by the CHP just a few weeks ago.

In both cases, there was no arrest... just a confiscation.

My assumption on that is that the officers honestly aren't sure it's an AW and confiscate to confirm. Assuming that it is, they can always serve an arrest warrant later.
This reduces their paperwork and possibly being put in the position of having a false arrest case.

It is a limit in some states.

Im not surprise if someone at DFG found this thread. If it was me, I would threat them with a law suit or they can choose to do voluntary work at CGN boot for a whole year.

Long guns aren't registered.... had he taken your 10/22, he would have found the same thing.

OTOH, situations like this, there is something to be said for a Vol-Reg.

Wonder what he would have done had it been VolRegd?

As of 1:56PM I got my gun back. I was hunting with it. The rangers took it because they thought it was a AW and wrote me a citation for 12280. I told them I was clear from AW because I have a Bullet Button on it making it a non-detachable magazine. He went to check if it was registered as a AW and couldnt find it so he said it was AW. I went to the shop I purchased it from and got a purchase record and faxed it to DFG. He called back saying he was mistaken and I can pick it up. So I did.
When I got there he said he didnt realize it had a BB, I told him that I pointed that out first before he confiscated it, but he seized to hear me out.

The question now is, should we press charge? Im thinking about it. I drove 10 hour round trip because his negligence!

PS: Its not illegal to hunt with a AR. thats just FUD.

PSS: How can I forget, I am SO SORRY, the frustration just got me all raddeled! THANKS EVERYONE FOR YOUR SUPPORT!
The problem is he's covered by qualified immunity and the state will drag out the suit for years. Suing the state is a pain in the arsch. I doubt you'll find anyone who'll wanna touch it.

There is a registration for AW in CA tho, and that is what the DFG officer was searching for.

                              Thanks for the references Cokebottle.

The weird feeling many of us had about the first post was that it did not include a reference to a citation or arrest, which had in fact happened. It was an understandable omission.

I usually take the side of the cops, but if the OP isn't fully compensated for his time and angst, the agent is at least "getting away with it", and might be in the wrong line of work as well, and that isn't right.
