What would the charges be in CA?

Maricopa man facing charges for nearly beating man to death

    July 26, 2010

A Maricopa man is facing charges of aggravated assault with a dangerous weapon for allegedly nearly beating a man to death with an aluminum bat.

The alleged beating occurred Sunday morning in the 43000 block of W. Elizabeth. The owner of the home, Chad George, 22, became involved in a verbal conflict with the victim, according to police.

During the verbal conflict a female tried to diffuse the situation; however, she was inadvertently struck. The verbal altercation became physical, according to police, with George allegedly striking the victim several times in the upper body and head with an aluminum bat.

The victim, a 22-year-old male from Maricopa, was transported to Maricopa County Medical Center in Phoenix, with life-threatening injuries.

George was booked into the Pinal County jail on charges of aggravated assault with a dangerous instrument. Several other individuals on the scene were cited for underage consumption of alcohol.

Maricopa police detectives are still actively investigating this case. No update on the condition of the victim has been provided at this time.

If he dies, it'll be murder...so since it's life threatening....it should be attempted murder...

My guess would be assault with a deadly weapon.....PC245 I believe. Felony Battery for causing great bodily injury.

They'd prolly stack some other charges on there as well, like a 12020 possession of a baton/billy club charge.

They could prolly stack 4-5 different felony charges on him and to get him to plead down to just the ADW charge.

The DA would probably go for the highest likely conviction - attempted homicide. Other included could be assault with a deadly weapon, possession of a deadly weapon, swearing on Sunday, etc.

Unless the victim dies, they'll plead out to a lesser crime and never see the inside of a courtroom.
