    Wondering about a legal question

Hey calgunners, i had a few questions i wasnt too sure about and i was hoping you guys could help me.

My question is, if i am IN my home can i legaly have my pistol in a non concealed holster? ALSO, say i was working in my garage or someone knocked on my door, and i answer. Having the pistol holstered on my side, is that considered brandishing a weapon?

The reason why im asking, is that one time me and my buddy were working at night in my garage (garage door was open) and someone came in thinking we left it open. We were working quietly and i guess he didnt notice us in the 3rd car section of the garage. As soon as he saw us he turned around and left. i wondered what would have happened if he had a weapon of some sort. Thats all, hope you guys can help. thanks!

If you are inside your home, you can carry a loaded weapon either concealed or in the open. No worries about the holster.

If you are in your garage with the door open, someone might consider that to be a semi-public place (e.g., you are having a garage sale at the time). In such a case, you can still carry concealed but you cannot carry loaded. More on the semi-public place stuff here in Gene's wiki article.

If the garage door is closed and people like the mailman don't normally come to your garage when paying you a visit, no worries, you're good to go with concealed and/or loaded.

ETA: Answering the door with a holstered weapon is not brandishing. You are not displaying your weapon in a 'rude, angry or threatening manner'.
