    PRE-BAN AR15 DOJ List?

    Heres the Situatuion
I was solicited to purchase an AR15 that is Pre-ban, how can i tell if this weapon is or is NOT on the Pre-Ban list with the DOJ. The Seller states that paperwork was filed in 1998 and has been lost since. Can i just call the DOJ and check by Serial number? Is there an actual list? If it is not reguistered with DOJ, what then?
    Thanks

look at the AW flowchart, http://www.calguns.net/caawid/flowchart.pdf . In it you will find a list of all the "banned by name" make/models. If it is one of those, then it is an AW and you can't buy it. If it is not on the list, but is in an AW configuration, you can't buy it. If it is off-list and the owner wants to remove any "evil features" and then have CADOJ deregister it, he could then sell it you since it wouldn't be an AW anymore.

"pre-ban" and "post-ban" are federal terms that don't really mean anything in CA.

Do you want an AOW or C&R SBS/SBR in CA?

you should have a letter back from DOJ stating so. But the catch is banned by name RAW's have no way they can be sold in CA unless it's to a FFL with an AW permit or a LEO with a department letter.

Are you talking "pre-ban" as in California or the Federal AWB as that expired is no longer in effect? If you are saying registered than probably mean California, and that cannot be sold or transferred anyway so the question would be moot.

If registered, the owner should have a letter from the DOJ Firearms Division listing model and serial #.

But it's not relevant anyway - the firearm is not transferrable.

OK, the owner of the firearm can request a printout of any firearms that are registered to him, http://ag.ca.gov/firearms/forms/pdf/...ateCitizen.pdf . That should show any AWs that are registered to him.

My main point still applies, If the firearm in an AW, you can't purchase it from him, period. It does not matter if it is "pre-ban" or not. It doesn't matter if it is registered or not. If you did not possess it and register it before the registration cut-off, you can't possess it, period (unless you are an LEO (which it doesn't sound like you are) that can get an AW registered).
