    BATFE has issues... with my MOM!

    My mom is an avid firearms enthusiast, in fact, she's the one that got me into it when I was 8 years old. Anyway, my mom has been telling my about her adventures in firearms purchasing in Las Vegas. My mother is from the Philippines, but a U.S. citized. She's never been in trouble save for a DUI that was reduced to a misdemeanor, 1st offense (she's learned her lesson). In the past few months, she's purchase an XD9 and a Stag M4gery. The first purchase in NV typically has a 3 day wait. After that, you get your bluecard and supposedly, there no wait. That's how it worked for me when I lived there. Anyway, when she bought the AR, she had to wait again for 3 days. The nice gentleman at the gun shop explained that she should write the BATFE regarding the NCIS check and her situation. So she did. She got a letter back stating that the reason behind her background check issues was that records indicate that she was a convicted felon that had served at lease 1 year in prison! Ok, my mom has never served time and she only had fines and community service for her DUI misdemeanor. The letter also stated that the department couldn't find any info supporting that she had been convitcted? I have heard of the credit people having issues, but the BATFE and NCIS? WTF? So now she has to write in again with proof of her status that she is not a felon so they can clear her for future purchases. I find this funny because if she's a felon, she shouldn't have been able to buy the last x amount of guns she has. But she did and every place, including a large chain store has let her take them. Does any of this sound weird to you guys? She's not upset, just shocked that something like that is on her record, and she is dealing with it right now. Doesn't seem to be a difficult fix, but it sure seems inconvenient.

    How is she supposed to prove she's not a felon?

    Dear BATFE,

    Enclosed is a copy of my certified Not A Felon card. As you know these are issued at birth, and taken away if one commits a felony. Therefore, I cannot be a felon.

      By going to the County Clerk of the jurisdiction that this possible crime was committed and to ask for the records showing she was not convicted. There will be a small documents and copying fee I'm sure, but it'll provide proof for her.

        If someone was injured in the DUI then it could have started out as a Felony DUI. I would think that it would be based on what she plead to. So in that matter I would think its some sort of mix up.

          She's got the documents and she had good correspondence with the agencies that are involved. If something goes awry, then she'll contact the attorney that defended her. The funny thing is that she has purchased firearms since and it wasn't a problem. What is annoying is that she has to wait the three days instead of getting it instantly. Must have been some clerical error on the court's part.

              Well that's how it started out, but she plead to a misdemeanor. She was never convicted of a felony and the judge even got on the DA's but since my mom had a clean record, no speeding tickets, and the DA wanted to throw the book at her. I think it was something to do with her running for City Counsel, which she ended up dropping out. Anyway, she's a pretty cool mom. She's a 5 foot nothing AR wielding, XD shooting, CCWing, dinner cooking, bad mutha. She is looking at getting the civilian FN PS90 in green for her next addition.

                  Doesnt surprise me. Had a B.S. run in with local PD bout 5 years ago resulting in some of my firearms being taken (roommate with B.S. 5150, they claimed no way to completly secure the firearms.... yada yada) Went to get the guns back and DOJ told me I was prohibited since I had a restraining order against me.....and that was DEFFINITLY news to me. They heard from lawyers at lightspeed. I had a COE faster than I thought certified mail capable of.

                        I've been down this road. The County Clerk does not house all of the records. Not only that, but the BATF does not check with local jurisdictions. They check with the FBI and possibly the CADOJ.

                        When I submitted my request for the info they had on me, the CADOJ, I had to complete a lifescan application as well as pay some money...I think around $40...that covered the fingerprinting and application.

                        Took about 10 days but I did get everything I requested for the CADOJ. The FBI request is a bit different and takes up to 6 weeks.

                        If anyone wants the details on what you need to do to request a criminal background from the FBI or CADOJ let me know.....

                            If your mom is ticked off about a 3 day wait in Nev. think about what the people in the PRK go thru.
