Doesn't matter, the mags belong to you. Only way for him to use them is with you present.

ETA: I was responding to the OP, it doesnt matter what mags the gun came with back when it was bought. If a new owner didnt have them at that time they should not have them at present time.

If they are REGISTERED as California Assault Weapons they are non transferable. They can only be sold through a dealer with an assault weapon license to an out of state FFL (dealer).

If they are off list lowers there is no registration. You can transfer them to your son without a DROS or PPT. If you transfer them to a relative other than your son or daughter you will need to do a DROS and PPT to transfer the firearms to them.

A word of warning! If they are on the named on the assault weapons list and are not registered they need to go away. Arizona, Nevada, Blow Torch, Etc.

Ok, so maybe I am right in wanting to register the AR and AK to him now. They are not assault rifles yet, but who knows in 2-4 years they might be.

They are OLL but if the 94 ban goes back into effect, they may be added.

Do you see where I am going with this?

Therefore, I will keep the handguns with hi capacity mags and the Ruger .223 with high cap mags and give him the AR’s and AK in case they are added to a list at some point.

There is no registration at this time for Long Guns as such passing them on to your son will not be a problem since they are not AW's. No registration is required unless another Ban is imposed and the Ban requires registration.

As far as I know, the OP gave his son ALL his full capacity mags back in 1999. There is no minimum age for ownership of mags. The kid could have been one year old.

Rgerber - you should totally do it! I don't know if my dad could have transferred all his guns into the names of me and my brother, but I wish he had! Sounds like it's too late to do some of the stuff, but it's not too late for other things! Transfer what you can now. If the laws get more strict in the future, at least he will already have the guns!

I lost an HK and some other guns. Just the other day, I found I couldn't keep his AR I don't know if my dad would have been able to transfer those guns into my name when I was just a kid - probably not. But it might have made a difference. Now all those guns are lost
