Buying a gun from a dead guy

    Well, for me, I've already bought three items from a recently deceased gunowner. Very simple transaction.

    The Deceased left everything to his family. The Parents gave the guns to the Siblings to dispose of. As the Executors of the Estate (Siblings), they sold the guns to me through an FFL. I paid my DROS and fees, waited 10 days, and now I have another man's possessions. It was a simple PPT.

    If there were any paperwork to be done on the Estate side, I'd have to ask the Sellers or the FFL, both are friends of mine.

      Well, Cannoneer, you kinda touched on the same idea that Doorman had, but ytour first ideas were wrong, the deceased's heir(ess) is not looking to give them away for free, but I'm sure that I won't be paying insane prices.
      Actually, his first ideas were a joke. Jokes aside, he is right. A dead person cannot sell anything because they cannot consent/enter into a contract/sale. The guns are now part of his estate, as is all of his property not held in joint tenancy, etc.

      I would speak to the probate attorney handling the case because the guns might not be your friend's entirely (you said "kids" meaning others might have a right to them) and if she sells them for less than what they are worth, she might lose out on other things. Fighting over money within a family can happen to anyone.

        That would be perfectly legal if they are all 50+ year old C&R long guns. I'll bet that's what Big Jake meant.

          I would hate to be the cause of a dispute between the (adult) children, but it would appear that each of them are assigning themselves sections of "dad's things" to dispose of, per the wishes of the spouse.

              the guns were left as part of an estate. this is where the "there is no registration law in california" part comes in. they were not sold or given to anyone. they were willed. the child is the legal owner. have her take the guns you want to the ffl and do the ppt. she doesnt have to reg them first. she doesnt even have to reg them if she keeps them.
