Seeking Advice on Gun Services Problem

Before I get started I recognize that maybe I didn't do a very smart thing. With that said here is my problem.

In late November 2009 I responded to a post on another forum about an offer to perform some trigger work on my Marlin Model 60. A number of members on that forum had already sent their parts to have the work done so I felt OK with doing it as well. So I send my action and trigger to this guy in Kentucky along with the funds to do the work. In order not to drag this out I will abbreviate all the steps I have taken and just say that I have asked and been told numerous times that the parts have been sent. But when pressed the guy always had an excuse why they were not yet sent, such as:

    1. I had the H1N1 flu and in the hospital.
    2. Computer is broken.
    3. Lost your address.

So now its been 10 weeks when the guy said the turnaround time was one week and still no parts. My last action was to send a Certified, Return Receipt demand letter for my parts. Just sent yesterday so of course no response as yet.

It also appears that I am not the only person who cannot get their parts returned. In the end I will certainly report this person to the other forums administrator.

Any advice or suggestions how I should proceed with this if the demand letter fails to produce the parts? Thanks for any advice in advance.

Is the guy a licensed Gunsmith? (having an FFL) If so then you might be able to get some info through the BATFE, if not and you sent the receiver to a non licensed person accross state lines you could be in a bit of trouble.
I would try to get in touch with others who sent their stuff in also.
There are 3 kinds of people in this world.
The wise, learn from the mistakes of others.
The smart, learn from their own mistakes.
The others, well......they just never learn.

No he is not a licensed gunsmith. I have been in touch with others in the same situation and we are all basically sending the demand letter as a first step. What's curious is that some have received their parts while others have not. Apparently small claims court won't work unless I go to Kentucky to appear. Cheaper just to buy a new rifle.

I am going to report this to the local distict attorney in Louisville if my demand letter doesn't produce results. In the end I think I might just be screwed out of the parts.

The receiver and barrel are seperate from the action/trigger on a marlin 60. Technically it is only parts, not a firearm.

Yes that's correct, I checked on that before I sent the parts.
