    More FUD from a gun dealer

    I picked up my Daniel Defense DDXV today. When I was in picking it up the shop mentioned that they had talked to someone from the DOJ recently and he said that the second I dropped the magazine on my bullet button equipped rifle it becomes an assault weapon. Then they told me that I not only had to buy a lock, I had to lock the rifle before I leave. Of course that created the problem of how to lock it with a cable lock without removing the magazine. I even offered to separate the upper and lower before I removed the magazine, but they wouldn't go for it. Finally they just let me leave without locking it. They didn't even sell me the lock, they gave me a child safe lock that said it wasn't for resale. Doesn't the law say that they have to sell me a lock?

    I know they meant well and were just trying to follow the law but it seems to me a gun dealer should be more familiar with the laws.

    I probably won't be going back there anyway since they charged me $100 dealer fee and $35 "DOJ transfer" fee. I wouldn't have bought it there if I knew they charged that much, I just assumed they would be reasonable since they only charged me $25 to transfer and AK receiver a couple years ago. I know the DOJ fee is only supposed to be $25 and I even asked about it today and she said $25 was for the DOJ and $10 was a "paperwork" fee. I know its illegal to misrepresent dealer fees as state fees and the receipt clearly says "DOJ Transfer $35" but I don't want to report her or anything, she must be about 80 and as far as I know she is the only FFL in town besides the Hardware store.

    Anyway, I'm just blowing off steam, I guess I'm still a little upset about her charging me that much. If your going to charge $110 for 20 minutes worth of paperwork it seems like you could at least know the laws.

    I'm still happy though, I got my first AR today.

      well lets see if transferring from out of state then add $50 then $35 for dros plus tax. But if thats not the case then you got ripped off. BUT thinking about gas price to drive there n there to dros costs money so you could say broke even or saved money...

        Yeah she can pretty much charge whatever she wants since she is the only FFL in town but $110 plus for a few minutes worth of paperwork is a little much. Next time I think I will drive 2 hours to an FFL that won't try to rip me off.

            TDS in Loomis is $35 for PPT plus a $40 Admin fee..whatever that is, ends up being $70 total. This means I won't be going to them for PPTs

                Nope... the law says that the gun must be furnished with a lock, or the customer must have a lock that they have purchased within 30 days.
                My XD9 came with a lock when new (and the shop did not lock the action open and install the lock... I took delivery just as Springfield delivered it to them).

                As far as dropping the mag on the BB-equipped rifle, FUD.
                The law says "Capable of accepting a detachable magazine".
                Dropping the mag makes the gun "Capable of accepting an attachable magazine", which is not illegal. Once installed, a tool is needed to detach it.

                  Always ask what the transfer fees are first. We had a spat of dealers in the Bay Area trying to overcharge.

                    Yeah, that fee is just a punishment fee for not buying from them. If they don't have it or it's too expensive, then that's their fault. They should be competitive, you'd think, but it's easier to sucker people in on high fees.

                    At Roger Relics here in Santa Clara, they charge a flat fee of $50 plus $25 DROS per gun. Most shippers charge $20-30 but some offer free. For multiple guns from the SAME dealer, Roger Relics charges $40 plus $15 per additional firearm plus $25 unless they're handguns in which case I believe there is an additional $25 fee per extra handgun-(if it were PPT for eg).

                    I see alot of gun shops with nothing but time on their hands on certain days, so if they kept the right guns in stock, they'd have capital to increase their volume of sales and if they charged a more competitive price, they could make more money. Some people will drive 1-3 hours just to save 30-40 bucks. Setting the correct profit margin to sales volume ratio is crucial.
