    Hi all, I am new and have questions. I will give specfics. on 7-3 i was seriously drunk and I threatened to harm my self. when the LEO's came to my home I was waiting out side fully dressed. I had the weapon that i threatened my self with Locked in the safe. So i was detained, I was fully compliant, and not combatitave. I was taken to the hospital for 5150, at 1250am my bac was .15 at that point. I stayed in the er till 530am and mental health took me till 8am and released. So the City i live in are now trying to take all my weapons> I had the 30 day hearing and they want a 1 yr ban from me having my weapons. I have since purchased a weapon and had no problems with the back ground. But my question is? I wasnt held, I was drunk off my butt, I had marriage problems, Not a issue since filing for divorce. I have seen a doc for alcohol. Would it be wise to write to the city attorney to Drop the case against me?? I want my weapons back, as I have many that were not only my grand fathers but my great grand fathers? Please advise. I so can take the truth. tks

      Given how you acted while under the influence of one and in possession of the other, perhaps it is best that you don't have one until you learn to control the other.

      Have them released to a family member for safe keeping and plan on hiring an attorney.

        My wife's Criminal justice teacher is a Cop and she said that a police 5150 is a intimidate no more guns for you. try and petition the court to have it over-turned.

          Another option is to find a gun store willing to store your guns. They'll usually charge you a storage fee.

            Huge +1. In this case I tend to agree with the City Attorney. I think from your description of the events that you should NOT have guns in your possesion. That's what family and good friends are for in a time of need.

              So you threatened yourself with a weapon and then put it away, yet you are surprised that they would want to take them away? Hmmmmm. If you have threatened yourself once, you may do it again or harm someone else with a weapon. No one needs that. You would be lucky if it is only a year ban. Life is full of choices, and you made a few bad ones.

                Sounds like you make poor decisions, both while sober (the decision to get drunk) and while drunk (the decision to act the fool). Accordingly, I personally think you need a multi-year to lifetime time-out from being able to own adult toys (aka firearms).

                Harsh but true... your actions do not help non-idiot gun owners to exercise our rights.

                  They 5150'd you so looks like you are going to have to surrender the weapons at least for a year. Unless you can somehow fight it in court although from what you stated in your op the chance of that seems to be slim.

                    As stated before, immediately transfer them to family or friend. Get an attorney and plead your case. Perhaps alcohol rehab is in order. Good luck.

                        My brother-in-law had some issues of a similar sort a number of years ago. He called family up and permanently transferred his gun collection to family and friends who were willing to buy. The deal was if he ever got way past it, he could buy them back at current market rate.

                        He got money to help with the legal and medical issues and we got good deals on some very nice weapons.

                        I think it was a very manly move, actually. It showed he was accepting his situation and willing to do what it took to get better. I have a great deal of respect for his decision.
