Got a friend asking me how to fill out the form. He has a few KD striped lowers and wants the register them as pistols. He is wondering is he should checks "semiauto" or "single shot" under type of handgun. Also wondering what he should put in for barrel length...

this is a grey area idea that one can take a "long gun" DROS stripped receiver and volreg it as a handgun, in an attempt to avoid SBR issues in CA. I don't think anybody has done this yet, so being able to tell you the "correct" way to fill it out would be difficult.
One issue I see with filling out the volreg is, can you "pre-register" a handgun before you actually make it, or does it have to be made before you can register it. If you have to actually make it first, and CADOJ decides that you've made an SBR because that "long gun" DROS forever taints the receiver as a rifle, then you've just admitted you made an SBR by submitting your form. IF you later say, oh, I didn't make that handgun (SBR), then you've admitted to having committed perjury on that form.Jack
Do you want an AOW or C&R SBS/SBR in CA?

In the title it says new resident so I am assuming he just moved into california. If this is so, then there is no DROS done on the stripped lower. It would just have the 4473 marked as other. So it is neither a long arm or a handgun. I don't see why it can't be vol reg as a handgun. Am I missing something?Last edited by smokingloon; 10-06-2009, 12:57 PM.Comment

oops, I missed that part, I thought he was talking about a CA-resident who was trying to do a volreg on a stripped long gun DROSed receiver to turn it into a pistol. There have been threads about that, and I assumed the OP was talking about his friend wanting to use that method to get a CA-legal AR-pistol.
I dunno what the proper way to "new resident" stripped receivers would be. I'd guess I'd mark "other" and specify stripped pistol receiver. And maybe put down N/A for barrel length and caliber, since there currently isn't any. Or, you could possibly put down the specs on what you would be building it up as, but that starts getting close to perjury, since you are describing something that doesn't exist.Jack

I am currently in the process of doing this very thing. I have dual residency with Nevada (Yes it can be done). I have a Nevada ID Card to prove it. I purchased three stripped lowers on 08/14/09. I brought them to California and filled out the voluntary registration form. I listed the receiver as (other, frame) (caliber, multi) and (barrel, none). I sent the $57 check and I hope for the best. I may get a few calls from DOJ or worse, have a Special Agent knock on my door. We will see. With these tough times; I'm not sure I will be able to keep two of the three consecutively serialized receivers once they are registered. I may have a posting in the "for sale " ads soon.Comment

This is something I've been asked about by friends... and I haven't had an answer to. I'll be interested to see if CD is contacted.I am currently in the process of doing this very thing. The receivers were 4473'd as "other" in NV, and can be legally built in to a pistol or rifle. My friend is buying property here in CA and would like to fill out the new resident handgun ownership record and register one of the striped receivers as a pistol before he builds it.
pretty straight forward, I've seen people here in CG doing this.
But hes stumped on the questions about semiauto/single shot and barrel length.Comment

To avoid any uncertainty, he can always just leave the stripped lowers in Nevada until he has built or is ready to build them into California compliant handguns. Once he moves the guns into California he has 60 days to register them via the new resident handgun report. The 60 days doesn't start when he moves here to become a California resident. It starts 60 days after he moves the handguns here as a California resident.Last edited by Mssr. Eleganté; 10-07-2009, 8:50 PM.__________________

hummm... so if he were to build the pistols with different length barrels, he could build them them, then note the information? Is there any limit on the length of a pistol barrel? And if he regs them as say 10" barrel but later changes out the upper for something different, does that matter?Comment

DOJ sent me my original application back and highlighted "caliber" and "barrel length". They kept my check. The application states "under penalty of perjury" so I can't very well say it's a 5.56mm, 7.5" barrel on a stripped frame. I guess I'll call and ask what exactly they want me to put.Comment

No such thing.
California has a weird definition that says handguns have less than a 16" barrel. So, that's your barrel length limit.hummm... so if he were to build the pistols with different length barrels, he could build them them, then note the information? Also, once the pistols go above 26" OAL, they become long guns. That's not super important, as you can actually legally go between pistol and long gun, as long as the long gun or pistol wouldn't be classified as an AOW. You can no longer go back and forth once you add a buttstock to a long gun.
No, it doesn't matter if he registers them as 10" and swap out the barrel for something longer/shorter later on. As long as the SN#'s match up, it's all good

Laws that forbid the carrying of arms...disarm only those who are neither inclined nor determined to commit crimes...Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man.
