    Off List AR Lower with DPMS Upper , CA Legal?

    Hello,
    I have been searching the forums hoping to find a specific answer to these questions, hoping that a senior member in the know can advise.
    I have always lived with the credo that it is better to ask a dumb question than make a dumb mistake, so please excuse these if they seem obvious

    Q1)
    I have a CA Legal, off list Kaiser Lower ( made here in good old San Diego ) .
    I would like to purchase a DPMS Flat Top Upper for it ( they are around $410 at Midway ) , it is 16" , Bull Barrel, No Bayonet or flash suppressor

    Having seen that DPMS:Panther is listed in Appendix B , would this upper be legal when mounted to the Kaiser Lower, with Bullet Button Mag release?
    Are the listed "rifles" in Appendix B specifically referring to FFL licensed lowers, or uppers as well?

    Q2)
    Can any .22 Upper be used with Off List AR Lower ? ( provided fitted with removable 10rd mag? ) . Specifically I refer to the CMMG 005, which has a suppressor and bayo lug ? If not, can anyone advise which .22 complete uppers are fully legal?

    Q3)
    Can one replace the monte carlo, factory supplied plastic stock on a Cali Legal Saiga EAA 7.62x39 Sporter, with a Saiga Wooden Monte Carlo Stock set ?( there are great ones at Saigastocks.com )
    Are there any issues with replacing original factory OEM furniture on these Cali LEgal Saigas ( the .308 Version of this rifle is sometimes supplied with nice wooden stock) These are not thumbhole or pistol grip stocks.

    1. Not a problem. The list ONLY applies to the lower (except in a couple of weird circumstances with RRA rifles).

    2. Bayonet lugs are never considered to be 'evil' features under CA law. Features like flash hiders or pistol grips only apply to centerfire rifles with detachable magazines. That upper would be fine.

    3. No problem there either, as long as the rifle remains 'featureless' (i.e. no pistol grip, flash hider, etc)
