    Gun Vault Ad

    Was looking through the San Jose Mercury News yesterday and saw this 1/5 page ad in the Local Section. Been quite a while since I've seen any advertisements for gun stores in the Merc!

    BTW - I don't work at this place nor am I affiliate with this place in any way. Just thought it was great to see such a big gun store ad in a liberal newspaper like the Merc!

    Good to see them advertising in mainstream media.

    It'd be even cooler if it was a shop who charged the correct and legal amount in PPT fees and wasn't trying to get over on their customers and fellow gun owners...

        Yes, I saw that. Still seems VERY lame, not to mention illegal. Expanding the lameness of the situation is that they think not charging as long as it is on day 10, and ONLY day 10, justifies the extra charges. It does not.

          I dont work there, but why is it illegal? the fee seems to only apply if you dont pickup on the day/time as posted on your DROS.

            The 10 days is the earliest possible time you can legally take posession, not the only time.

            The following PC is what makes it illegal, note the "no other fee" portion:
            12082. (a) A person shall complete any sale, loan, or transfer of a firearm through a person licensed pursuant to Section 12071 in accordance with this section in order to comply with subdivision (d) of Section 12072. The seller or transferor or the person loaning the firearm shall deliver the firearm to the dealer who shall retain possession of that firearm. The dealer shall then deliver the firearm to the purchaser or transferee or the person being loaned the firearm, if it is not prohibited, in accordance with subdivision (c) of Section 12072. If the dealer cannot legally deliver the firearm to the purchaser or transferee or the person being loaned the firearm, the dealer shall forthwith, without waiting for the conclusion of the waiting period described in Sections 12071 and 12072, return the firearm to the transferor or seller or the person loaning the firearm. The dealer shall not return the firearm to the seller or transferor or the person loaning the firearm when to do so would constitute a violation of subdivision (a) of Section 12072. If the dealer cannot legally return the firearm to the transferor or seller or the person loaning the firearm, then the dealer shall forthwith deliver the firearm to the sheriff of the county or the chief of police or other head of a municipal police department of any city or city and county who shall then dispose of the firearm in the manner provided by Sections 12028 and 12032. The purchaser or transferee or person being loaned the firearm may be required by the dealer to pay a fee not to exceed ten dollars ($10) per firearm, and no other fee may be charged by the dealer for a sale, loan, or transfer of a firearm conducted pursuant to this section, except for the applicable fee that the Department of Justice may charge pursuant to Section 12076. Nothing in these provisions shall prevent a dealer from charging a smaller fee. The fee that the department may charge is the fee that would be applicable pursuant to Section 12076, if the dealer was selling, transferring, or delivering a firearm to a purchaser or transferee or a person being loaned a firearm, without any other parties being involved in the transaction.
            (b) The Attorney General shall adopt regulations under this section to do all of the following:
            (1) Allow the seller or transferor or the person loaning the firearm, and the purchaser or transferee or the person being loaned the firearm, to complete a sale, loan, or transfer through a dealer, and to allow those persons and the dealer to comply with the requirements of this section and Sections 12071, 12072, 12076, and 12077 and to preserve the confidentiality of those records.
            (2) Where a personal handgun importer is selling or transferring a pistol, revolver, or other firearm capable of being concealed upon the person to comply with clause (ii) of subparagraph (A) of paragraph (2) of subdivision (f) of Section 12072, to allow a personal handgun importer's ownership of the pistol, revolver, or other firearm capable of being concealed upon the person being sold or transferred to be recorded in a manner that if the firearm is returned to that personal handgun importer because the sale or transfer cannot be completed, the Department of Justice will have sufficient information about that personal handgun importer so that a record of his or her ownership can be maintained in the registry provided by subdivision (c) of Section 11106.
            (3) Ensure that the register or record of electronic transfer shall state the name and address of the seller or transferor of the firearm or the person loaning the firearm and whether or not the person is a personal handgun importer in addition to any other information required by Section 12077.
            (c) Notwithstanding any other provision of law, a dealer who does not sell, transfer, or keep an inventory of handguns is not required to process private party transfers of handguns.
            (d) A violation of this section by a dealer is a misdemeanor.

                Have you ever been there? I doubt it. It is because of this BS over a few dollars that more then one gun store does not want to deal with Calguns people. I use to think that was a foolish attitude for a retailer but now after reading some of these juvenile posts from 14 year old lawyers, I have to rethink my position. If I owned a gun store and and some one came in and said," Hi, I am a member of Calguns can I get a cheaper price?". My answer, sorry no. We try to have fair prices for everyone.

                  Ok, so I'm just going to throw this out there. *I've* been there, but it still doesn't change my desire to pay only the normal $35 for a DROS. So what about visiting the store was supposed to change my mind and entice me to pay the extra $15?

                    I feel you are missing my point. It's not about expecting some kind of "deal". It's about expecting a fair price, the price that has been mandated by the state. The same price EVERYONE is supposed to pay in the entire state of California. Calgunner or not shouldn't matter one bit. If I have to follow the rules about participating in PPT's, they should have to follow the pricing rules surrounding them. If they really did have fair prices, there wouldn't be an issue here.

                    If they had pistols for sale $50 higher than the next closest shop, that wouldn't offend me. If they sell their ammo for twice as much as the next guy, more power to them! But this tacking on fees when they already know better than to do that...that obviously really rubs me the wrong way.

                    To make my point as basic as I can get it, it's not about their prices in general, but instead it is specifically about the BS $15 storage fee. Oh, and of course the further $5 a day storage fee added on after the first three days that the $15 covers. There's nothing you can say that will make that right because it just isn't. $35 TOTAL - $25 to the state, $10 to the FFL. That's it. It's not a deal, it's what is fair.

                      There's going to be the 1st anniversary sale from Aug. 28-Sept. 2. If you're not too busy whining maybe stop on by and get some deals on things!

                        I have to agree, some calgunners like Ladyfox are terrific. Very nice and it's always fun to show her something new, but when I get people who think they are the shiznitz just because they keyboard commando on CGN, makes me sad to think I am apart of this community.

                          I like going to the shop, good place. However, they are dumb for having an illegal policy posted on their web site regarding PPTs. Just charge the $35. and forget about it.

                            Since I am main one who has an issue with your illegal fees on PPT's I can't help but feel the comments above are directed at me. If so let me clear the record and say:
                            1) I am not the spokesman for the CGN community, just myself.
                            2) I'm hardly a keyboard commando or internet tough guy. I'm not saying I'm going to beat you up or huff and puff and blow your house down. No threats, no blood boiling. I simply won't shop there and would encourage others to shop elsewhere as well until you change the PPT storage fee policy.
                            3) As nice as your offer was phrased to stop by I think I'll have to pass as I believe in voting with my wallet. The fact that you are an hour away doesn't preclude me from doing business there but your policy on PPT fees does. It's the principle of the matter. I won't do business at ANY shop that charges extra PPT fees and of course, you are far from alone in doing so. No need to visit a shop that starts off like that when there are plenty that treat me right.

                            My main point in posting originally was to maybe educate someone who didn't already know that the fees being charged by BAGV were not in line with what is spelled out in the penal code. You seem to know that already as do many of the posters so keep on keepin on!
