    Standard Cap Mags

    I'll be in state for a week on business and I'll be armed. Did that mag case ever get resolved or do I need to bring one of my sub 10 round pistols?

    There is a prohibition in place prohibiting enforcement of one new law regarding possession of standard cap mags.

    There is a separate prohibition against importing any standard cap mags into the state.

    AS I read it, I as a resident cannot take a magazine I legally possess out of state and then bring it back into CA.

      It has not been resolved and currently being held up by the Ninth Circuit Court of Appeals.

      It is still illegal to import large capacity (11+ round) magazines into CA. [PC 32310(a)]

      It is still illegal to import handguns that are classified under CA laws as assault weapons (e.g. semi-auto pistol with no fixed magazine and with threaded barrel) [PC 30600(a)], short barreled rifles (e.g. handgun with brace) [PC 33215], short barreled shotguns (handgun that shoots shotgun shells) [PC 33215] or other generally prohibited weapons.

      In order to be legal for transport, the firearm must be unloaded and in a locked container. [PC 25505 and 25610]
      ^In addition, while outside of a vehicle, the course of travel must be directly to and from authorized locations (e.g. vehicle to temporary residence, temporary residence to vehicle).

      In order to legally leave a handgun in an unattended vehicle, the handgun needs to be unloaded and in a locked container that is hidden from plain sight or in the vehicle's locked trunk. [PC 25140(a)]

      While inside your temporary residence, it is legal to have or carry (open or concealed) a loaded firearm. [PC 26055 and 25525(a)]

            32310.
            (a) Except as provided in Article 2 (commencing with Section 32400) of this chapter and in Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, any person in this state who manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, lends, buys, or receives any large-capacity magazine is punishable by imprisonment in a county jail not exceeding one year or imprisonment pursuant to subdivision (h) of Section 1170.

              Thanks for correcting that, I meant to say when we are at the range we can use my standard capacity magazines together: )

              Is that ok with the cadoj POS jackboot enforcers..rot in hell traitorous scum?

                A loan of a large capacity magazine to a non-prohibited person at a location where it is legal to possess firearms/ammunition and the lender being physically present for the entire duration of the loan is CA legal. [PC 32415]




                Penal Code 32415
                Section 32310 does not apply to the loan of a lawfully possessed large-capacity magazine between two individuals if all of the following conditions are met:
                (a) The person being loaned the large-capacity magazine is not prohibited by Chapter 1 (commencing with Section 29610), Chapter 2 (commencing with Section 29800), or Chapter 3 (commencing with Section 29900) of Division 9 of this title or Section 8100 or 8103 of the Welfare and Institutions Code from possessing firearms or ammunition.
                (b) The loan of the large-capacity magazine occurs at a place or location where the possession of the large-capacity magazine is not otherwise prohibited, and the person who lends the large-capacity magazine remains in the accessible vicinity of the person to whom the large-capacity magazine is loaned.
